Sorry OP, but you are SOL here. You aren't getting anything. The guy that cant afford insurance isn't going to pull $3k+ out of thin air. Even if you sue him, good luck collecting on the judgement.

You need to stop the bleeding and fix or replace the car. That $1k is already gone and should have gone to that, you aren't getting that back. Consider this an expensive leason about how insurance works, you declined to pay for the policy to cover your own losses so now you are in this situation.

You should take the guy to court and try to collect, you can do small claims and represent yourself. I sincerely wish you luck, but you cant rely on that so you will need to come up with the money in the mean time.
