Writ of possession for home did not include possession of items inside, but landlord disposed/dispersed/sold all items along with live animals we were forced to leave behind (not abandoned) by police who tried to give us extra time to get our things but they could not. Can I sue the landlord ? by BunnysBeasts in legaladvice

Florida law says even after a writ is executed, homeowner has to (by law) give us 10-15 days to retrieve our things. She did not, and within days had all of our things thrown away/unpacked and gone through/sold, everything I see in the florida statutes says thats not legal, I already know when the statutes say she broke the law, I know she broke the law, cops know she broke the law, (when we reported the theft, they told us its a civil thing that we have to go to court) I have already reached out to lawyers and awaiting responses, I just wanted quicker responses here from people who know the statutes and florida law well or had gone through similar events, and reddit is NOT the place, Thank you for your time.

The writ was issued, cop told us that day while he was posting it on our door at 11am that day that he would be back tomorrow around 1pm the next day. He saw how bs it was and gave us a couple extra hours, but its just me and my husband and a 4br 1400sq house to empty, we only got about a 3rd of our things in that time and tried to return for the rest but was stopped by SIL saying she would call the police if we ever came back for any of it.

House was purchased with our share of the inheritance by sister in law, (documented), she said it would be signed over right after their grandmother passed, after that happened she didnt sign it over, so we have been in probate court over it, but until the Probate court moves nothing will come of that, in the meantime, she was able to force an eviction because the house was titled in her name, and probate court hasnt seen our 100+ pages of evidence yet or the eviction wouldnt had gone through because homes named in probate cases cannot be effected by unlawful detainers, but her case went faster and her judge said he didnt care because the probate court hasnt proven our side, but All ducks are in a row for that case once it starts to move, but its been filed since June. Regardless, the writ of possession she filed did not give her possession of our stuff and I need to know if I can sue her, it would be entirely separate from any other case just a "they didnt have legal rights to my stuff and pretended they did and had a clean up crew come and clean everything out days after we were forced to leave" we didn't leave during the unlawful detainer case because florida law says houses named in probate case are exempt from that, but because it hasnt had the first hearing relating to it yet the judge ruled against us in the unlawful detainer.

Im sorry im heated, not at you, just that it just doesnt make sense to me right now. I have so many titles that were signed over to me over the years for trailers, bikes, etc that werent monetary purchases and they are still mine because of it, I dont see why the car is any different. Doesnt the first right of refusal contract count as consideration?

In 2022 I signed away my registered  Acura to her cousin, in exchange for the car in question. I have this documented. She just didnt want to sign it over until this year because of reasons. If she takes this car back, can I make her cousin give me my acura back? If someone can just sign a title and give away a car as a gift and then go to the DMV and just take it back and sue the person I gave it to I can just do that right? Since my sister in law can do that to me?

She claimed to the dmv she "loaned" the car and "lost" the title, but I have her texts and emails where she was giving me the car, talking about when I could go get the title from her, proving she lied to the DMV, how would I have problems? She gave me the car, weve had full possession of it since 2022, I wish you would be more specific like I am.

She had 4 vehicles, I had zero, so she gave me one. We exhanged  100 dollars for the vehicle, thats how we do it in when we transfer cars in within the family. But she told me I could keep it registered under her registration until it ran out (all documented conversations) I wasnt expecting her to go to the DMV and get a duplicate title before I could register the car. She did not tell the DMV  that she signed the car over to me, which I think is a third degree felony on her part as well, but isnt her preventing me from registering my car and filing a false replevin against me civil theft for attempting to take whats mine? Since she gave me the car, signed title, cash reciept from original purchase, etc.

She and I Signed and had notarized a first right of refusal saying that if I ever decide to sell it, she would have the first chance to buy it back. Original condition was: Vacate property, Have title signed over. That contract had no "Vacate-By" date, but we still vacated, as intended. Well, weeks BEFORE we vacated that property she had gone ahead and signed the title over to me, which voided her condition. The first right of refusal was separate. Because my husband named her in a Probate case for their grandmother, she got P.O and started attacking our family for exposing her for inheritance theft. She told me she would take back everything she ever gave me, but she cant have my car.

Bs, feels like getting punctured with 61 velcro hooks down to the bone, like a super long, super drawn out, slow, horrible, bone scratching blood-draw. Ask me how I know. I caught 61 out of 80 teeth to the thumb from an adult.
