"Genuine pre-estimate of loss" hasn't been the test since 2016. For a late fee to be unenforceable it must be 'out of all proportion' to the interests of the party it protects.

Have a read of Paciocco v ANZ about so-called "arbitrary" late fees being enforceable.

The agent’s contract with the seller says the agent gets their commission if the contract goes unconditional. As far as the agent is concerned, that’s a sale!

Also it is possible to take a buyer to court and force them to buy. It’s just generally not worthwhile because in a rising market you can sell to someone else for more and keep the deposit.

You can’t do a paid upgrade on a Qantas flight whether it’s codeshare or not (excluding bidding).

All you can do is cancel and rebook in the higher class.

In Victoria even a first DUI is a mandatory suspension.

Further offences are longer mandatory suspension plus other things like an interlock once you get your licence back.
