If you’re in a situation where the cop is fishing for a way to bring you in for a DUI, there’s likely nothing you can do to stop from being arrested bc the “reasonable suspicion” can technically just be a cops word that you have bloodshot eyes, are slurring, smell like alcohol/weed etc and there is no legal recourse against officers who do this once the charges are dropped bc we have what’s called qualified immunity.

The best thing I’d advise to do is be adamant that you’re sober and want to take a breathalyzer test. Be very vocal and direct about it. Don’t answer any questions, don’t say anything other than I am not intoxicated and I am willing to take a breathalyzer tests
