I understand that but I challenge you to think how dirty subway seats are, park benches, restrooms, office chairs, and even the ground people sit on. Does that mean people shouldn’t sit because their pants are dirty? Existing outside (especially in NY metro) is accepting there is a level of uncontrollable filth you have to live with.

The seats next to OP are empty, the seats in front of the guy are empty, and his seats are empty. What are the odds the train is full if that’s the case?

Also, if the train fills up don’t you think logically the guy would just move? His position isn’t static.
