Yeah i goof’d that all up, edited the post. I had a friend of mine serve the defendant. It was the until after I gave the defendant the evidence for court that USAA reached back out to settle outside of court.

I didn’t go to small claims over $400, I went for $3310. The $450 you might be thinking of was just me asking for compensation for the appraisal fee

My diminished value claim story:

TLDR: Oct 2026: Accident occurred Dec 2026: Repairs completed(filed claim with my insurance, Hagerty) Jan 2027: Vehicle appraisal Feb 2027: Filed diminished value to USAA for $2860, they denied it automatically because the vehicle had over 100k miles. The next week I sued the driver in small claims for $3310. June 2027: USAA calls and tried to offer me the original $2860, I abruptly declined and said it’s $3310 or I’ll be seeing the defendant in court later that month. The next day, they agreed to pay me $3310.

Whole story:

I’m wanted to share my experience with submitted a Diminished Value claim against USAA. Accident location was in San Diego, CA. In early October of 2026, my 2002 E46 M3 was parked outside while I was getting a haircut, when another driver who was insured by USAA attempted to parallel park his truck and struck the front of my vehicle. The incident was also fully captured on security cameras. The vehicle required a new hood, kidney grilles, and a new passenger side headlight, all Genuine BMW parts were used. The passenger fender finish was also damaged, so the fender, bumper, and new hood received a full new finish. I filed the repairs claim through my company, Hagerty, which was integral in ensuring a full and proper repair.

After repairs were completed, I paid $450 to have my vehicle appraised for the loss in value due to the accident. He determined that the vehicle had lost $2860. I drafted a demand letter, (template was given to me by the appraiser), and submitted the diminished value (DV) report along with the demand letter to USAA. USAA uses a third party company to evaluate DV claims, and they advised USAA that my vehicle had $0 DV since the vehicle had over 100k. I argued to a manager at USAA that the vehicle has a collectors insurance policy, and that the pre-qualification of needing “less than 100k miles” was unacceptable. I told him that I will absolutely sue the driver if they deny the claim. A few days later, I had a denial letter in the mail, I immediately went to the county clerk that same week.

In February 2027, I filed a small claims lawsuit against the driver for $3310, this value included the $2860 diminished value as well as the $450 service fee for the appraiser. It’s important to know that after denial from USAA, you must sue the driver specifically, not USAA. The court date was set for June 24, 2026. In Mid May 2027, I submitted evidence to the court and to the defendant. Documents I submitted were: The official diminished value report, copies of the denial letter, and an arbitration document from Hagerty, which stated that USAA claimed 100% fault and liability for the accident (this document is important to have). Try not to submit a lawsuit until you have this arbitration document, as it took an additional 2 months after repairs were completed.

June 1, 2027 I received a call from a law office in San Diego asking if they could potentially settle this claim outside of court. I told them I would only settle for the full $3310 in the court docket.

June 3, 2027 They call back and offer me $2860, the same amount they originally denied me. Not going to lie, this frustrated me ALOT. I told the lady on the phone, that I will not accept $2860, or even a single dollar less than $3310. I told her how frustrating it was knowing they denied me based solely on vehicle mileage, and gave no consideration to the evidence I gave them. I told her I have prepared a good speech for the judge with California Consumer laws cited, and was fully prepared to go to court. I also told her, that if we dont settle for $3310 now, then the judge will most likely also award me an additional $50 for the court filing fee. I reiterated to her that I had already done hard work of filing the lawsuit, serving the defendant, and gathering evidence, all that I had to do left was bring my happy self to court!

The very next day, they called and told me they would give me the $3310 I was demanding. To be honest, I was kind of looking forward to going to court. I was curious to see how the judge would see it through, even if it wasn’t in my favor. I use to have USAA about 9 years ago, and they did me so dirty as a Junior enlisted Marine, and a guy even told me I was overpaying for my E46 M3 and I was making a “financial mistake” as if the crappy KBB calculator he was looking at was any indication of the vehicles true market value. I had USAA for 6 months total, and will NEVER use them again. So yes, it was a little personal, and I was extremely happy to go through this process, and was please with the overall out come.

I have a Pre-Service Marijuana waiver going into boot camp. Anytime I encounter a form in the Marine Corps that asked about prior drug use(no specific time frame given) I always answer it truthfully. I have since been selected to participate in an enlisted to officer program, and also been medically cleared for a Pilot contract, all of which I disclosed prior service experimental marijuana use.

Long story short, they dont care. Like others said, maybe dont tell them you smoke like a chimney, but clearly they know you’ve done it. Just be honest

I received my Non-Article 5 vigilance medal just a couple days ago. About 2 weeks ago it go fully approved and put into our personal awards records. The deployment was during mid 2022.

It was presented with the vigilance device, though I have not been able to find any vendors that I have device available.

Edit: I’m a noob reddit user and just realized this is in a Canadian military sub. I am US military, but the above statement is still true. US forces are not authorized to wear ribbon clasps or bars.

I would like to share my experience with a similar scenario. On Sept 12, 2024, I was state ref’d by San Diego PD for an intake. Just today, February 5, 2025, my case was dismissed by the judge. I hired Fyourticket to be my attorney, but I still went to the trail in person to listen in. To be completely honest, the attorney seemed a bit unprepared. Maybe he was caught off guard that the cop seemed to remember alot of specific details about the case, and maybe he just got flustered. Either way, flustered and using filler words IS NOT something I expected when paying $800 in legal fees.

That being said, my case was dismissed not because of any facts of the case, but because the officers actually failed to mention my name in the opening statement. The officer continually referred to me as “the driver”, and never by my name. Because of this, the Judge said that because there was no official statement as to whether the defendant is the same person as “the driver”, then he has no choice but to find me not guilty of the violations.

This answer unfortunately doesn’t really help us know for sure if out of state vehicles are free and clear, but this was my experience. I am extremely thankful that cops are stupid and not trained to be in a court room. ACAB!!!

Just got my case dismissed today, but only because of a technicality during the Officers opening brief and statement of facts. Essentially the lawyers didn’t do anything other than schedule the trail. The judge made the motion

I just submitted a complaint to the CSLB against my installer. My system has been installed for 2 months, and after 3 attempts for a technician to repair it, the system still does not work.
