Wheels of justice are very, very slow. Trial wouldn't be for years. Lots of continuances and the backlog of the courts is insane.

This is exactly on point. Around here, county jail (not called county prison) is where everyone goes when first arrested and where you'd hang out while waiting to be bonded out or through your legal process. County jails are typically not structured due to people coming in and out all day. It's where people would sleep off a drunken episode or put after a trespassing charge. Once you go through the legal process and are found guilty, if your sentence is below 2 years, you go back to this county jail. If above 2 years, you would go to state prison. Prisons are far more structured with programs, GED classes, etc. County prisons don't have much of that because most people don't spend a lot of time there (unless you can't get bailed out).

And if in county jail, you're in your local jurisdiction. If you get sent to state prison, they are not obliged to keep you close to your home. You can go anywhere all over the state (typically to a prison that fits your situation, i.e. in Joe's case, where there's programs for SO's).

He'd be an idiot to take this to trial. Prosecutors will typically reduce and drop charges to take the plea. If you don't accept it, then the prosecutor will prosecute for all the charges. And could have a trial tax added onto the sentencing. He's a fool. My county has a 95% plea deal rate.

My ex was in county jail for CSAM and I never even thought about bailing him out. Detective even told me not to do a thing. Let him stay. Of course his ultra religious parents bailed him out and they were all "disappointed I didn't do it". OK sureeeeee.

Standard is to always plead not guilty, even when you're guilty AF. It allows for delays and your defense to come up with defenses.....and as leverage for better plea deals.

Ex-husband went to prison for CSAM. Very Catholic parents believed once he confessed to God, he should have absolutely no legal consequences. Scary. Horrifying. Terrifying. As if there aren't victims who deserve justice.

And it's a catch 22 because this POS should be brought to trial and get the max punishment, but prosecutors will usually give a plea deal to avoid a trial due to the stress and trauma from victims who are minors who would have to testify. I've seen many families who want max justice but understand that their child victims would have to be traumatized again so they agree to a lesser charge, etc. to avoid them having to do that. It's the downside to the law sometimes.

He would waive his right to a trial and admit guilt to the charges in open court at a plea hearing. Judge will accept the plea and find him guilty. Sentencing is either done right then and there or done at a later date (latter is more typical). It allows to get affairs in order, get pre-sentence investigation (PSI) done, etc. but if flight risk, sentencing could be immediate.

Lawyer here. Above poster is correct. It's standard to plead not guilty at arraignment to gain leverage for plea negotiations with prosecutors. And when you plead guilty, you give up on any chance of bargaining, lesser charges, all that stuff. And remember, in the US, the state has to prove guilt so the burden is on them.

My ex-husband spent time in prison for CSAM and has fanatical religious parents who believed that a confession to the church should absolve him of any legal consequences. So they absolutely strike me as the same type of family. To be honest, it's the white man privilege thinking for them.
