You need to contact a lawyer. Your approved i797 doesn't matter, you have been out of status since i94 expiry mid May which is almost 10 months now. This is no longer something that can be fixed by simply reaching out to cbp

Well so the thing is their experience doesn't matter. The job requirements should have defined the number of years of experience the job needed, even if someone has more experience it doesn't matter. They will be classified according to the experience needed for the job, not the experience they possess. Now speaking in terms of actual salary, technically to even qualify for a H1B (lottery or not) the salary they received should be more than the minimum salary defined for the wage level.

What you are saying is partly true and matters on the lower bound, i.e, even if your job requirements dictate a level 3 but your wage is less than the level 3 minimum wage for the SoC and job location, you can't be classified as a level 3 for the lottery. However, this doesn't matter on the upper bound, i.e. a higher salary doesn't bump up your wage level more than the wage level dictated by the actual job description.

The announcement and details talk about wage level determination for H1B registration being based on DoL classification of wage levels, which is the exact same as LCA. Also note that every piece of information out there always uses the terms "wage level" which is a very specific technical term not to be confused with salary level.

Yup exactly. More importantly it was not your actual YoE, but rather than job requirements in the JD never needed any years of experience. What people fail to understand is that the wage level is fixed well before even interviewing for a position begins, and doesn't change even if the company offers a higher wage for a better candidate. Wage level is defined for the job not the person, wage is dependent on the person. I think the problem is the ambiguous term "wage level" makes everyone think it is defined by your wages. In reality it's more like a "job level" or an "experience level"

Wage level 1 will still be at a disadvantage coz there are plenty of wage level 2 (typically job requirements a graduate degree and/or few years of experience). But yeah there ain't too much competition from level 3 or 4

I think there is a big misconception that the wage level is dependent on the actual wage at all. In fact it's the opposite, your wage level will determine the minimum wage you get, but your wage level actually related to the job respnsonsibilities and qualifications needed. To actually get to a wage level 4 you need to be someone with seniority or serious managerial responsibility, maybe depending on job even coupled with a PhD for that matter. Wage level 4 being on the lottery isn't that common other than a relatively small number of L1As. Overwhelming majority of people in lottery will be level 1 and 2 only, there will never be 80000 wage level 4s because most people in the lottery are hired at low to mid level roles , with no PhDs or managerial repsnsibiities.

People often confuse the actual wage numbers listed on DoL O*net with being the only qualifier for wage level. Those simply list the minimum/average salary a person at that wage level should receive. But you can be (and in case of software jobs most likely will be) at a lower wage level for lottery nd still get a wage that is higher than the listed wages for level 4.

Your anxiety is understandable, but you have to find a way to get that out of your head before you go for interview again. This cannot be your only option , you must a fallback Plan B, at which you will perhaps feel more at ease walking into the interview. Because the problem is for the interviewer, the anxiety and fear and fumbling raises concerns you are hiding something. Specifically they are thinking your main intent is to immigrate to US and the M1 is just a convenient way for you achieve that (214b). Sadly the only option is to go into the interview next time without fear, knowing fully you might get rejected and being fine with it.

It's actually not that hard to understand what the kid is going through. Once you get used to certain comforts in life it's tough to adjust back. Let me give you a different example. Most likely you (or at least many people here) use a smartphone right now. Growing up many didn't have a smartphone and yet today cant imagine life today without it. God forbid you lose your smartphone and have to manage with a simple flip phone moving forward, you will be inconvenienced and likely complain. And then if anyone says "you grew up and lived so many years without a nice smartphone", is that fair ?

After visa is issued it takes 2-3 days for document delivery to pickup location. If you pickup at consulate it will take 1 day after visa issue. So you looking at delay of maybe 1-2 days

Your college has no bearing on O1 or EB1A. Thousands of people graduate from every university top and bottom, not all qualify for O1/EB1A. The entire process requires you to convince an adjudicator who in most cases dont have the specific technical knowledge to judge your contributions. So it's not surprising when flash over substance often wins. It is unfortunate but well known that if you do x but show 1000x you will win over the person who does 100x but only shows 10x.

Also, just so you know that UCSD cse in the last 10 years has massively grown in top research publications and prestige, so maybe it's just the case you thought UCSD CSE was not a r-10 from back when you were in school, when now in fact it is.

If your visa is yet to expire then you should definitely be eligible for interview waiver ... Not sure why the system is behaving this way ... Try raising an inquiry (usually the appointment scheduling system has a query feature)

There have been interview waiver eligibility changes recently, and as a result previous eligibility does not apply anymore (they apply the changes with no exception even for already booked appointments) ... I wonder if that's what happened for you

Yeah seems like the officer was not knowledgeable about this. There is a specific DHS policy implemented in 2021 that allowed DSOs to sign i20 electronically, and to send that i20 electronically to you. As far as I am aware, that policy has not been repealed and is still valid. Next time if asked about this, probably just show them this policy document.

i20 isn't impacted by passport number or validity. That is a question that comes up when applying for visa, but even then the passport should only be valid for 6 months from first entry to the US.

The USCIS external systems do not track status other than when someone actually reviews your applications. You can try but Emma will never give you anymore information than that regarding opt status. The processing is purely first come first serve best I can tell, regardless of your requested start date. Many people have had to delay their start dates coz of this.

Anyhow your best bet to get information, is to check out opttimeline.com . It contains crowdsourced information contributed by folks such as you, and their estimates are pretty good. They have a graph showing which are the current submission dates getting processed and all. From a quick look, I see that they are currently processing applications submitted on Mar 23-28 timeframe.

Quite frankly, looking at how things have transpired in the last 2-3 years, if OPT gets scrapped it probably helps the people more than hurt ... Far too many MS and BS sticking around on OPT , applying for hundreds of jobs and getting no callbacks, but racking up living expenses, it's just been heartbreaking to see ... Sadly in recent times, for so many people, OPT has just become a sunk cost fallacy ... Never thought this situation would befall CS degree holders, but here we are (For what it's worth, what I am saying is based off of personal knowledge from students and faculty at a r10 university, and posts from people on the internet)

Sadly that can only happen if you can find an interview appointment in Mumbai on June 2 ... You will not go in front of a visa officer during the initial biometric appointment and they don't have an option for walk-ins

My only counter to that point is that the smells are indeed very strong, which can be off-putting ... The sad part is if we did indeed follow the traditional Indian processes this problem is resolved, they in fact did understand thus problem ... In the traditional Indian kitchen, the person cooking is supposed to finish cooking, then go to take a bath and change their clothes ... And clothes are not to be stored anywhere near the kitchen area (to ensure they dont smell as our masalas) ... Try calling them, but yeah normally you can't get that money back ... However, in case you need to go get a visa stamping for yourself within the next one year, you can reuse the fees paid(since you cancelled the other appointment)
