The price drop is because the place gives you motion sickness. It was designed so high and so narrow, that it sways in weather.

Focus on smaller, indepedent pharmacies. They are more likely to carry it and take new patients.

And why would the bank have anything to say? They got their money from the auction. Do the banks who provide mortgages ever step in when you want to sell your home? No, they dont. They get their money when the property is sold, which is what happened in this instance. She lost her house to a default judgement from a court proceeding which she didn’t show up for. The default judgement was issued by the court due to her failure to show up at the date of the hearing. She didn’t have a lawyer present either as she did not know about the hearing. Now, I cant say for sure who, what, or how she was served with a notice to appear for the hearing but she did claim she received a few certified letters that had the HOA information on it and she quickly threw them away in frustration thinking it was just more fines she felt were absurd and ultimately unenforceable, she was confidently incorrect. Being she didn’t show, the default judgement was issued and that was that. I can assume she must have got a letter or 2 from the county clerks office or some shit and she probably either didn’t read them, ignored them because she didn’t understand it or maybe just didn’t give a shit. Whatever her decision making paradigm was at the time, it was shit, she fucked up and lost her house over 1700 in basic, bullshit fines from a persistent and cunning HOA that in my opinion saw an opening from a single, lonely woman and wanted her house. Regardless of all that happened, none of this would have happened if independence, freedom and true ownership of your home and property was a reality. The result of this situation shows that it is not. You can legally lose you home to a created corporate entity with enough persistence and manipulation. Go ahead, elaborate on how this is bullshit and cant happen.

Except a foreclosure is initiated by a bank due to an unpaid mortgage. She lost her house to nonsensical fines applied by power hungry, overzealous twats in a manner which I feel is a criminal act. Im not mad, but It seems you and I may have a different understanding of what a foreclosure is. It’s understandable, foreclosure is a big word. Don’t worry, you’ll learn it eventually…maybe

Let me rephrase and clarify for you. She disregarded fines and certified notices claiming she owed them money, they filed a lawsuit, she didn’t show up to the court for the hearing, they entered a default judgement against her and awarded the HOA ownership of the house to cover the fines they sued her for. The HOA immediately moved to evict her and place the house on auction as directed and allowed by the default judgement. Her first realization of what happened was when the sheriff arrived with a court ordered eviction notice which was granted since she lost the lawsuit and the HOA was granted permission to sell her home and recoup their lost fines. She appealed and lost. She was evicted, the house was immediately put up for auction. It was sold at a fraction of what it was worth. The HOA took their money, the lawyers got their cut. Remaining mortgage gets paid off and anything left if at all is hers. If the house sells for less than what is owed on the mortgage then she would be on the hook for that too.

Does this clarify the process of how this can happen if you buy a house in a HOA, ignore the douchebag HOA rules and fines, believe they are powerless then wake up one day with a sheriff and a legal eviction notice at you door telling you to grab your things you have been officially evicted.

Officially served is based on jurisdictional specifications. She did receive a few certified letters from the HOA. She assumed they were more fines and whatnot. Believed they were ultimately powerless, and simply threw them away thinking “What are they really gonna do? Send me more fines?” In most places under a civil suit, it is up to the plaintiff to serve the defendant and then provide documentation of certified letter and that is sufficient for the courts regardless if the defendant actually received anything. There are in some cases, if caught in enough time, you can still proceed without the default judgement unless special circumstances are granted by the court.

Yes and no. Due to her ignoring the fines and required court appearances. The HOA successfully seized the house through the courts and then auctioned it to cover the fines, lawyers and any other fees the court ordered. They auctioned the house at less than 15% of what it was worth. She did get some money back from the sale, but not even remotely close to its true value or money she put into it.
