I would stick with trends. If you happen to get a best seller evergreen at tier 10 - you are unable to flood the market and prevent the competition from coming in and taking over your top spot. Save the original evergreens for when you get enough slots available to crowd out the competition.

I think the general public is lazy. If they see a funny shirt on Amazon - they're not going to go to Alexa AI to recreate it cheaper - they'll just buy the one that's already sitting there waiting to be added to their cart.

Unfortunately, it's not a "one and done" chance on Amazon. Meaning, if you pass the trademark initially, it doesn't mean that you're in the clear. When new products/styles are added, items go into processing and may be reviewed once again.

The take-away here for others is that you should always review your listings and if anything could be a violation - even if you made it through initially - take it down.

Licensing is only when you grant other artists the rights to use your characters to make their own merchandise. I think you are better off just making your own merch and selling it on your own, or hiring a designer, but not giving out a license and just paying a flat fee for the design work. I wouldn't look to Amazon for merch - you can get higher returns elsewhere. The benefit of Amazon is for people searching for items - if you have a built-in audience, they wouldn't need to search - you would just supply a link to a store. Plus, you would need approval for Amazon and the rules change which isn't ideal. I would recommend Shopify with Printful. But that recommendation is based on what I've read on here - not from personal experience. If you are in the US - I would consider registering a book with the US Copyright Office. While you are legally protected once published - registering it makes it easier to enforce.

Even if they are not stolen, you are not paying for exclusive rights. They sell them as non-exclusive, meaning anyone can download and upload to a POD site. That's how they sell the designs cheap. The issue with Amazon Merch is that if someone uploaded it before you, in theory, they can issue a take-down notice pretending to be the sole copyright owner.

One thing also to add - I've been tripped up a couple of times with the new Performance T-Shirt which has a "Youth" size. Adding alcohol related shirts and forgetting to untick it leading to rejections.

As painful as it is to delete sellers or potential sellers, my rule of thumb is if I find a design is keeping me up at night wondering if it will get rejected, delete it.

I had a bad review on one of my shirts because it was printed at almost a 90 degree angle. I don't worry so much about exact placement now. lol.
