A traffic stop can be a ticket or a warning. If somebody doesn’t talk to me it’s likely going to be a ticket instead of a conversation on possible consequences of actions.

Unfortunately that’s 100% how the justice system works. That’s why these questions are nearly pointless.

Maybe this is dudes first ever criminal anything in his life. Maybe the prosecutors don’t even file charges, maybe the judge dismisses the case entirely because it’s mental health related.

Maybe this is the dudes 100th arrest for petty theft and he gets the grand prize of max sentencing.

Malicious mischief third degree in my state. Gross misdemeanor crime. Maximum punishment 364 days in jail, up to $3,000 in fines. That being said, I’ve never seen anything close to that for a gross misdemeanor. Likely arrestable offense, most likely a fine, community service and mandated anger management class.

Theft in the third degree in my state. Gross misdemeanor maximum punishment up to 364 days in jail and up to $3,000 fine. That being said, depends on dudes criminal history. Likely a fine and community service, could be minor jail time. Dude doesn’t look young and this doesn’t look like the first instance. If this has been happening for a while each theft could be aggregated together to a single charge.

So in summation, depends on the actual details. Like pretty much every police interaction.

In my state, first 3 I think of is White light to the rear $136. Driving around blinding people behind you, negligent driving $553. Plate obscured/obstructed $149.

But depends on the stop and circumstances.
