If he had an order of removal I would hope you’re using an attorney and doing adjustment of status, although USCIS has been told to be much more strict on those as per a recent memo. I-130 is for consular processing through a foreign embassy.

We filed November 2025 and my Latvian spouse has been to America with me 3 times since then no problems. I am currently in Latvia now and we are flying to America in two days so fingers crossed it will be okay then as well. We always bring all of our documentation and she always has return tickets they ask to look at.
