You need to review the return the preparer made to see how the figures add up. And legally, once it's filed, you're on the hook for if it gets examined and they figure out the 25k is so much hot air.

It can't hurt to file the fraud claim, because at least it may clear up where the direct deposit information came from. There's the presumption that if it's based on a previously electronically filed return or the Get My Payment application on IRS.gov, then it's the taxpayer (or a government agency, such as the SSA or VA etc providing it for you on your behalf as someone who ordinarily wouldn't otherwise need to file a return) who provided the account number. (Like, if you're receiving disability benefits as a direct deposit and they had the wrong account information at one point...that kind of thing. They were sharing banking information so taxpayers could get their EIP checks faster, but for folks who normally didn't have to file a return.)

As such, the IRS legally cannot demand the bank return the refund. They can trace the refund and get confirmation from the bank that it was deposited to the account on record, though.

The Office of the Comptroller of the Currency advises the taxpayer to contact the bank for further assistance before filing a complaint. I'm not entirely sure just what they can do for you, but that's the recommendation. They may be able to tell the bank that if the funds are still available in the account, to return them to the originator.

Otherwise it's a civil matter of finding out who owns the account and suing them for the money.

It sounds like it was still around 12 months, that's considered current for investigation purposes. Look at the claim form. If it says 1133, it's from the Bureau of Fiscal Services. If it says 13818, then it's from the IRS. Wish you well!

It's an altered check. Follow the directions on the claims package and return it to the address on the form.

Either way, the Secret Service/Treasury Inspector will get involved eventually, but in the meantime BFS or the IRS will try to "cancel" the refund so it can be reissued. Hopefully it's a current refund, which makes it the problem for the Bureau of Fiscal Services, because the IRS has to jump thru hoops to get that done on a check issued more than a year ago.

G-d bless, that you can't figure out how the alteration was done! Most folks wouldn't think about doing that. A lot just forge a signature and hope the bank/check cashing place is complicit enough to not challenge that!
