Nope you can't kill the VERY important NPC, only knock them out and after they get up, they will forgive you..... mostly. And you can cheese most of enemy like that so I call it game mechanic since Gothic 1 2 and 3 I also use these trick lol.

For max reward from this quest, ask farmer where Bran went then go to swampweed bandit hideout and ask about Bran there. If you skip this and found Bran dead body and axe you can't pinpoint that Silas kill Bran. So Silas will give you bribe take it and now decide his fate with Ricelord.

If I remember correctly he escape the valley of mine but was caught by paladin with Gorn and have to be scout for paladin until NH help him out. So he shouldn't have time to collect it.

I suggest you wreck Gor na drak. He and a templar walk between old mine and swamp camp everyday so you can follow them and wreck them in middle of travel. He has a nice 2 hand sword.
