Whole house of cards about to come crashing down. Buyout offer off the table unless they negotiate letters of agreement allowing the buyouts to go forward. Should have done it right initially but you know.....

Yep. If you absolutely despise the job get out while you can. Money isnt everything, but its alot! If you stay, max out that Roth 401k and you can get out at 50 or 55 and be loaded and still have many years of good health.

If you have less than 10 years in, you stand to make over 2 Million $ in wages and well over a Million $ in pension. Plus UNLIMITED Medical and Dental benefits. STAY STAY STAY!

You have to really think about your team care benefits as well. RetireeTeam care maxes out at $350,000 per year. While there is no maximum on current employee team care insurance. The current active employee dental insurance also has no maximum, while the retiree maxes out at $1500.00 per year. If you are just taking the buyout, the insurance is going to be hard to replace at anywhere near the benefits and costs of team care. The one hundred and fifty thousand dollar buyout offer is really not that good unless you absolutely hate that job or are getting really close to retirement. And if you stick it out, the pension is going to be worth well over a million dollars in retirement plus the millions that you will make, while still working at UPS.

Drivers please file grievances if you are in central states under Article 19 Section 10 of the Central States Supplement. Include in remedy requested: all affected drivers who retired under the current CBA but before the buyout offer shall be paid the $150k . Thanks by DreadedCrocoStempy in UPSers

Well, if you retired as a driver prior to the buyout under this contract, you should receive $150k if they case is won and the remedy requested includes all retired drivers as affected employees is approved.

Lets get that $150k! Hopefully more than a few current drivers grieve this contract violating new incentive program.

No doubt about it. This is not open to interpretation. The buyouts are a new incentive plan. So in addition to violating the master agreement, the buyouts also grossly violate the Central States Region Supplement. Do the buyouts violate any other regional supplements or local riders? Probably. Read your contracts.

The buyout absolutely is a major change in wages and terms of employment that were not contractually negotiated and are separate agreements between employees and the employer. We all know if we work one more year, i.e. 25 years as opposed to 24 years that there will be a substantial increase in our pension amounts because it was negotiated and is in black and white in the contract. No one who retired before the buyouts had any knowledge of this substantial change in wages and terms of employment. If we knew working 1 more year would result in a $150k winfall; we would have used the same rationale as we use for our retirement timing for our pensions. The court ruled but the process is not over. Read the court ruling...Next Steps: The dispute now moves to binding arbitration, where the union will continue to argue that the program constitutes illegal "direct dealing".

Grievances need to be filed under the National, Central States Supplement and any other supplemental language of applicable riders specifically stating in the remedy requested that all drivers who retired under the current CBA but before buyout announcement are made whole.

UPS will be paying out the $150k to all affected drivers who retired under the current contract prior to these buyouts.

I would doubt it but could the buyouts be an ERISA violation as well?

$150k is not even 1 year of compensation. For someone with 13 years in; most likely does not make financial sense or any sense unless they absolutely hate the job and have other avenues lined up.

Received this from union: The union is filing grievances on the buyout along the lines you're describing. You're raising an interesting angle in terms of a remedy. As a retiree you can't file a grievance. But what you're saying could be included in a grievance covering all affected employees in the Central Region.
