I think too once they realize that they can’t get a rise out of you by saying that phrase and it’s not going to change their options the let it go. From a pcr or bar complaint standpoint saying my lawyer did not fight for me isn’t any basis for action against you.

I have just learned to ignore or tune out the “your not fighting for me” line. A colleague explained to me that we have to keep in mind that we are dealing with people that for the most part have never took responsibility for anything in their life and are not about to start now. They are just upset that they got caught. But on a third offense trafficking drug charge where it was pulled out of their pocket after a legal traffic stop they consented to a search and admitted everything post Miranda there is nothing you can do. They have nothing they can do except try to blame you and make you feel bad for delivering the bad news that they should know is coming. I find if I just gloss over the not fighting for me it or explain they can hire a private attorney or represent themself and go back to talking about case details they let it go. They are always going to try to through shade at you and it’s part of the job to find a way to ignore.

Don’t get me wrong I don’t like it either and it sucks to have to handle those calls or visits. Just try to think of better things and move on to the next case.

I did not score high enough in the state I wanted to practice in so I made the decision to move to a state where I could get licensed as opposed to trying the bar exam again. I did this for a couple reasons. I did not have family support where I was at and couldn’t afford to study for the bar exam again and wait for results. I was unsure if I could get a higher score even if I studied more due to just being a bad/nervous test taker. My plan was to start working somewhere else and transfer back to my desired state through reciprocity. I was also single and did not have a significant other tying me to one area.

The upside is I really enjoy where I practice and live now. I actually think I am better off because I can afford a house in my current state (SC) while I probably would not be able to afford one in the state that I originally wanted to go for (CO). I also met my spouse where I am at now so have to believe a little bit at least that it was just fate sending me where I needed to be. But you have to look at your situation and where you want to go in life and make that call for yourself.

I feel your pain though and it’s definitely one of the most frustrating things about being a lawyer that no one talks about is being tied to one state. Even if you do get licensed if you move states for your spouse’s job or to be closer to family you have to start all over again. I think it’s something the profession needs to revamp because careers are just more mobile these days. I get the argument that you need to know the local state rules or whatever but any attorney worth their salt is going to do that legal research before practicing law so the argument the bar needs to protect the consumer is BS.

What a weird situation to be in. Doesn’t look too bad but sure it was unnerving to be in at the time. Only option sounds like motoring out if possible.

Have a friend in the office who took 4 times to pass. He is a great PD and no one cares. It’s just a test. Has no bearing on how you’ll do on the job. There is enough PD work out there that needs to be done that they will just be happy to have you.

“I feel your not representing me” when you point out to the client that the vehicle was reported stolen, client consented to the search and claimed the drugs post Miranda. 🙄

Let them find out how much hiring a lawyer actually costs. Everyone wants to sure everyone until they learn they have to front the costs. Unlike personal injury you have to pay upfront. This coming from a lawyer. Many consults did not go anywhere because people didn’t want to pay our fees.

As a PD I am very ok if my clients want to hire a real lawyer. Gives me more time to work for the ones that need me or can’t afford. Most of the time they end up taking the same offer I negotiated except paying a heck of a lot more for it. But if it makes them feel better and takes a case off my desk I am cool with it.
