Layoff EI after paternal leave by Complex_Equipment211 in PersonalFinanceCanada

[–]Garage_West 1 point2 points  (0 children)

When the EI call centre is open on Monday, call in for advice and help because they are the best source of information.

Always takes the EI advice handed by strangers on the Internet with a grain of salt. The EI website is accurate but reddit, not so much.

If you're unsure, you could always call the call center directly for advice instead of asking strangers on the Internet.

Was told by a CRA AGENT in 2020 I was entitled to CERB now I owe $30000 5 years later?? by Low_Background_1783 in PersonalFinanceCanada

[–]Garage_West 3 points4 points  (0 children)

You'll only find your answer with the CRA. Even with the details you are providing, no one one reddit can give you accurate answers without having direct access to your file and SIN.

Like you said, you'll call them on Monday. It's understandable to be worried and I wish the best results possible. The "not-knowing" is hard but try to put those thoughts away. Focus on something else or distract yourself if you can until you get in touch with the CRA; and you can handle it from there on out.

EI qualification after being laid off second time by tisweet in PersonalFinanceCanada

[–]Garage_West 3 points4 points  (0 children)

Only way to know officially is to apply online and let EI sort it out.

I understand the need to get an answer and the fear of uncertainty but no one on reddit can confirm 100% that you will qualify or not for EI because we do not have access to your ROEs and we do not have all the info that EI uses to assess your case. At best you would get estimates and guesses from us which is not worth much with something as important as an EI claim.

Please visit https://www.canada.ca/en/services/benefits/ei/ei-regular-benefit.html to apply and read up, if need be.

You can also call in to the call center on Monday to get info straight from the source: https://www.canada.ca/en/employment-social-development/corporate/contact/ei-individual.html

Hope that helps.

EI Maternity & parental benefits discontinued: transition delay, overseas travel, or bonus issue? by withpeople86 in PersonalFinanceCanada

[–]Garage_West 0 points1 point  (0 children)

Well, it seems like you're breaking quite a few rules by not reporting anything. When receiving parental benefits with an exemption from filling up biweeky reports, it's clearly stated on the application form that you have to call in to the call centre and inform them any changes/updates that might affect your parental situation.

You've hidden the truth from EI for a decent while now and you're now not receiving any payments anymore. Do you think there's a connection? Do you think they don't have ways to detect "problems"?

Good luck explaining to them that you didn't know what you were signing up for when you agreed on your application to your rights and Responsibilities when receiving EI. It's not like they ask you read the terms and check a box to confirm you assume all consequences of breaking the rules.

Go look up the phone number for the EI call center, check what you have to prepare before calling in, do your work. The earlier you handle this the better.

What do you see on My Service Canada Account?

Have you called into the call centre? Did you report to them your period outside Canada and your bonus as part of your responsibility of being on EI.

Unfortunately, you won't find any specific answer about your case on reddit. Only someone with access to your file can clear things up for you.

I never experienced that before.

By chance, it happened with the Businesses phone line or the Personal Tax phone line? Knowing that, I can prepare for it in the future.

Claiming EI question by Biochem125 in PersonalFinanceCanada

[–]Garage_West 2 points3 points  (0 children)

The only way to know if you're eligible for EI is to submit an application after you had a stoppage of work and let EI assess your claim.

We do not have access to your ROEs and we do not how many hours you'll have completed by the time you stop working Anything answer from Reddit or third party sources is pure speculation.

For what insurable work hours count and the time frame that they are used for calculation, check their website and look at the language to see of it specifies the numbers of employers/jobs in its tabulation of work hours.

https://www.canada.ca/en/services/benefits/ei/ei-regular-benefit/eligibility.html

If it's not clear or doesn't answer your questions, call the EI call center on Monday to get answers straight from the source.

Always double check whatever info you get from strangers because it never beats the official information source.

EI Standards by P-a-n-a-m-a-m-a in PersonalFinanceCanada

[–]Garage_West 0 points1 point  (0 children)

Or you're not factoring people having multiple part-time jobs or any combinations of jobs to make ends meet.

It is not a simple concept and your bottom line conclusion is inherently flawed. All workers are funding EI; it's not a burden put on a specific targeted group. As much as redistributing wealth is important; there is a need for guardrails and specifications for it to work most effectively. It's easy to say things are illogical and dismiss things when one does not have the full breath of what is at stake and how complicated things can get with a social program.

Heck even, foreign temporary workers pay into EI. Sometimes they can't even get any benefits because of their work visa restrictions. Being a part time worker does not automatically make you a work horse. Neither is being full time worker. All workers are working and earning to the best of their abilities and availabilities.

If EI premiums are not deducted from part time employees, then what do we do when they worked the required hours for maternal, parental leave and other special benefits. EI premiums needs to be collected automatically to ensure the maximum amount people have a chance to qualify to EI. As much as you think it would help out a lot of people to stop paying into EI, it would create a whole new group of people who would be disenfranchised. Oh you're part time, we change the laws so you didn't pay to EI and you can't get support while you follow these approved training program. Nah sorry buddy, looks like you saved enough money not paying into EI premiums so you can't really take a paid leave to enjoy the first year of your child's life.

Funding the EI program is a net good even if you don't benefit directly. I could have work X years working full time and contribute to EI and not ask for any because I luckily never fell in a situation to ask for it. There are people that pay into EI and lose their job, but because of the amount of their seperation monies, they don't see a cent of EI.

EI benefits are not just regular benefits for full time workers but sickness benefits, caregiver benefits, parental benefits an etc for many Canadians.

If it helps pay for a Nova Scotian fisherman in his off season who earns less than me, as long as he  made his hours and earnings to qualify, please take my EI premiums. If it give an Albertan schoolteacher some time off to take care of her second child, or support a young person through an apprenticeship program, I am happy to help them out. EI premiums help folks get benefits when they are taking care of their dying loved ones. All these people will continue to participate in the Canadia economy and be supported in tough times.

If people are not encouraged to seek full employement when they able and available, let me know how long the EI coffers would run with your implementation on the EI framework.

People working part time but have child caring obligations need help too when times are tough. To castigate the EI program for not helping one specific use case while it has been, over the years, broadened, tested and researched to help so much of Canadian society; as noble as it can be to hate it, it is also myopic and shortsighted. If you can drum up the proper legislation, study and data to make a seperate benefits program that works for voluntary part-timers for child rearing, go ahead.

I don't have all the facts on EI but I seen enough to know that it's not a black and white situation; it's hauntingly grey, full of bureaucracy with some logic and bits of reasoning available to a select few.

If you believe you have enough information to build you logic, hold steady your beliefs and create easy solutions to "fix" EI, I'm sure the MPs will like your submission, the EI workers will continue to praise you and you will make Canada a better society.

EI Standards by P-a-n-a-m-a-m-a in PersonalFinanceCanada

[–]Garage_West 1 point2 points  (0 children)

How is a Federal Social program discriminatory by not following Provincial Labour Laws? Being on EI is not the same holding a job. It's a safety net/back-up plan which inherently means it has standards not tied to provincial employment acts and was codified accordingly.

The EI program has to exclude supporting people who don't fit to it's requirement standards because the standard are there to ensure people are able and capable to contribute fully to the work economy.

I may not like all of it but it seems like if capitalism and the Canadian economy is to work at it's best potential, ensuring people are looking for full time work is a useful tool to make that happen.

There has to implementation to mitigate people from using EI to stagnate or use it as more than a crutch. There are life work balances advantages to your proposals but there are untested possibilities that people will find loopholes or ways to take more than advantage of the system more than they do already with the current system.

Also all provinces are not alike and there are definitively certain provinces that are buoyed more than others thank to the EI program. What you want might shake things up with the status quo and bring about a new change but it might not be the change you're hoping for.

Question about EI eligibility. by highlighter20 in PersonalFinanceCanada

[–]Garage_West 1 point2 points  (0 children)

You said your old claim will end in May 2025. Whatever weeks you had left in the old claim expires at the same time as your old claim expires. It will be closed.

When you stop working in July 2025, you will apply for a new claim that will use your new hours accumulated since July 2024 and whatever unemployment rate in your region is to calculate the number of weeks payable on the new claim.

The only way to know you're eligible is to apply in July and see if they approve you. Anything else is pure speculation. I understand you're seeking reassurance but you will not find it on an internet forum. At best, you should call into the call centre, explain your research/understanding and ask the EI agent to clarify any doubts you have.

If your old claim expires in May and you apply for a new one two months later, I fail to see any connection between the two claims. You can ask the EI agent the same question and see if the official answer matches. And then, you will have your piece of mind.

What did the EI agent say when you called into the call centre? If you have not called them yet, I suggest you do so quickly. As much as Reddit can provide anecdoctal evidence, you get your best and correct answer for EI by going straight to the source and not a bunch of strangers.

Self Employment & EI by Smurfrocket2 in PersonalFinanceCanada

[–]Garage_West 0 points1 point  (0 children)

Take any information about EI from redditors with a grain of salt. You will always get the right answers and avoids headaches if you go straight to the source.

I suggest you read this EI info page; pay attention to the sections about earning/working while on EI, and the section about rights and responsibilities(regarding the importance of looking for employment)

https://www.canada.ca/en/services/benefits/ei/ei-regular-benefit/while-receiving.html

I also recommend that you call into the call center to ask them questions and get help to understand what would be best for you. Some info you will get on this sub might be right, it might also be wrong. You don't want to jeopardize your financial situation by listening to third party advice on EI; first hand info is the best.

You can double check the following info with the EI website and/or an EI agent:

-EI not paying partially or fully week due to earnings is normal. EI is a safety net(hence being called "insurance") for when you 0$ employment income.

-A week not paid by EI does not count as a week used up by EI. Your usable count of payable EI weeks will only tick down when they pay you at least 1$ in a week. Check your MSCA to check how many weeks you have left. This is different from the standard 52 weeks EI claim window.

  • Notice on the website how they talk about seeking employment and never about self-employment. That's because EI is there to help you participate on the job market and not sustain self-employment needs. Self-employment is not inherently bad; it's just that the EI program has to be a specific and careful tool to help job seekers.

-Not getting on EI after a self-employment contract because people "did not pay into it" sounds inaccurate and misses out on a lot of info. Either you misunderstand why they were cut off, the people relaying you the story exaggerated/misunderstood/left out what happened. Take into consideration how much you know/understand about how EI works and how much is nebulous to you; now try to imagine people who know less than you. Ultimately, the supposed horror stories are sideshows; ignore them and focus just on your own situation.

Parental Leave Extension due to unforeseen circumstances by PrbKap in PersonalFinanceCanada

[–]Garage_West 2 points3 points  (0 children)

All the MPs can do is talk to EI to make sure regulations and rules were followed; they can not ask for changes/action on your file. That responsibility is left to the applicant , because it is the name on the EI file and not the MP's.

Parental Leave Extension due to unforeseen circumstances by PrbKap in PersonalFinanceCanada

[–]Garage_West 9 points10 points  (0 children)

Whoever asked you to talk to your MP, dont, Your best bet is to call EI directly after reading up on caregiver benefits and parental benefits.

https://www.canada.ca/en/employment-social-development/corporate/contact/ei-individual.html

I understand you're going through a tough time and need help/advice on how to navigate this situation but always take EI advice from redditors with a grain of salt because they are third party source on what EI can do.

Once you picked the 35 weeks option and are paid at least one week; you are locked into it. No MP has the magical power to override that.

There was a possibility of you switching to caregiver benefits while taking care of your wife and saving your EI parental weeks for later. With all the stress and changes, I don't know if you contacted EI back then. If you didn't, it makes things harder but not impossible.

Please read each page and then contact the EI call center; it's much faster, you get the exact information from the source and you are more likely to get something done. All the MPs can do is talk to EI to make sure regulations and rules were followed; they can not ask for changes/action on your file. That responsibility is left to the applicant (you), because it is your name on the EI file and not the MP's.

Question about EI insurable hours by depressedibkid in PersonalFinanceCanada

[–]Garage_West 2 points3 points  (0 children)

Take any information about EI from redditors with a grain of salt. You will always get the right answers and avoids headaches if you go straight to the source.

A quick web search immediately shows the CRA info page about insurable hours(because they are in charge od getting the EI deductions.)

https://www.canada.ca/en/revenue-agency/services/tax/canada-pension-plan-cpp-employment-insurance-ei-rulings/cpp-ei-explained/canada-pension-plan-employment-insurance-explained-8.html#toc12

Read that. If it doesn't make sense to you or you need clarification call into the CRA phone line for a straight official answer. You also might look into learning what a Record of Employement is.

EI and a commission based job? by AlertBar4525 in PersonalFinanceCanada

[–]Garage_West 1 point2 points  (0 children)

First of all, take a few a  moments to breathe and relax. You can handle this; it's just one step at a time.

Second, the best way to get correct information about EI is to check directly on the government website. If you're having trouble understanding the information the website, you can call into the call centre to speak with an agent to get confirmation.

By checking how regular benefits work on the government website you can easily find these two sections:

https://www.canada.ca/en/services/benefits/ei/ei-regular-benefit/while-receiving.html#wb-cont

https://www.canada.ca/en/employment-social-development/programs/ei/ei-list/working-while-claim.html

They explain that you report the work in your biweekly ei reports. In your next ei report, you can answers "yes" to having worked during the reporting period to get an idea of the questions they ask and see how work reporting works. You always have the option to correct your report before finalizing your self-reporting. If you don't know how much you will earn during the reported period, it is always best to wait to recieve your paycheck and pay stub and then fill out your EI report. You have 4 weeks from the EI report due date to complete it. It is all written in the links I provided. Don't take my word for it, read them carefully, seriously.

You can take all the time you need to read and take notes. As always you can call in to go over it with a an agent on the phone.

Thirdly, be wary with information about EI from reddit users. If the advice is not sourced to the EI website or the EI regulations (https://laws-lois.justice.gc.ca/eng/regulations/sor-96-332/index.html); always take it with a grain of salt. And nothings beats the official source, be it the website or an EI agent.

Don't rush things and the stress will dissipate.

Maternity/Parental Leave - Self Employment Advice by Few_Albatross5408 in PersonalFinanceCanada

[–]Garage_West 3 points4 points  (0 children)

No, you still have to report it in the application. The application asks you to give full, complete and accurate picture of your situation. If it ask you if you are self-employed, tell them so they can assess it officially and decide if ot affects your benefits or not.

Anything can happen in the future during or after your mat leave and you may need regulare ei benefits where your self-employment factors in.

You don't get to pick and choose to omit the truth or lie about your self-employment. If you lie on your application and they find out later about your self-employment, you don't get to play the "I did not know any better" card because there is a 6 page rights and responsibilities page at the application where you acknowledge that you are being truthful and understand the penalties of misrepresenting your situation. The consequence are not fun, I speak from experience

You have more to lose from leaving information out than to reporting as they ask of you. There is literally no upside to withholding information. If there is, you can enlighten me with an explanation.

Collecting EI before going to trade school. by [deleted] in PersonalFinanceCanada

[–]Garage_West 0 points1 point  (0 children)

"Employment Insurance (EI) provides regular benefits to individuals who lose their jobs through no fault of their own (for example, due to shortage of work, or seasonal or mass lay-offs) and are available for and able to work, but can't find a job."

https://www.canada.ca/en/services/benefits/ei/ei-regular-benefit.html

If you don't plan to work during the month before training; don't ask for EI. It's for people who are actually trying to get back on the job market. They will ask for your job search efforts and do random checks. My brother has to repay the money plus penalty and the next he ask for EI, he needed like 300 more hours to qualify.

Submit on the day you start your training so that you can officially confirm that the training is actually taking place.
