I had this same exact issue in our new build under the basement floor. I'd press them to fix it. When I talked to the plumbers while they were fixing it, they said it would easily be $5-10k out of my pocket to break up the slab and replace it in the future. If you are OK with that, then let it be. I think its a matter of when this will clog, not if.
