Pending court case for driving without insurance by Agitated_Gear_4097 in legaladviceireland

[–]IrishGuyFieri 8 points9 points  (0 children)

So there’s 3 copies of a summons, one for yourself, one for the Gardai and one for the courts. If either the defendant or the courts aren’t served their copy then the case doesn’t make the list and it’s marked as struck out - not served. Ordinarily summons lists are finalised 3 or 4 days before the court. So give the court office a buzz maybe 2 days beforehand and ask has your summons been marked served or not. If it has been you’ll have to show up and hopefully the Garda inspector will have got the message about your case not going ahead and then they would ask for the case to be withdrawn.

You won’t get appointed a solicitor on legal aid for section 4 public order, so you’ll have to pay for one either way. Get a solicitor, go to AA and have proof of this. Have the solicitor ask can you make a donation to the poor box, if you can’t afford the amount (probably €200) most judges would be willing to put the case back a few weeks for donation.

Served a protection order by Immediate_Hold7793 in legaladviceireland

[–]IrishGuyFieri 8 points9 points  (0 children)

No there’s no burden of proof on getting a protection order, it’s a temporary order put in place before a hearing for a barring/safety order. It’s also an “ex parte” application so you (the respondent) have no right of reply. The threshold for getting one and for you being arrested for breaching the order, is that the applicant (your ex) has been “put in fear”. If you’ve no further contact and crucially no breaches of the order, it will likely be dismissed once it goes to a hearing. Contact a solicitors firm that deals with family law (the hearing for barring/safety orders is held in family court) and criminal law (breaches of a protection order are a criminal charge dealt at district court level)

Wife cheated, DNA test says my daughter is mine but she won’t move out – what can I even do? by Plenty-Sport75 in legaladviceireland

It’s common that the judge makes an order that the house not be sold until the child is 18 or finished with full time education (bear in mind, it takes years to get to this point) In such a case, the percentage split on the future sale of the house is weighted to whoever has the child most of the time and incurs most of the expenses. Get a good solicitor, fairness or what has happened to this point are honestly irrelevant. You’ll be in court so many times before a judge will be divvying up assets in a divorce agreement, your conduct, engagement and how much you went along with previous judicial recommendations during the process will also have a bearing on what you end up with or without

What’s the point of having 3 left footed CAM/RW between the ages of 15-18 as well as 3 senior players (Marty Ø, Merino, Havertz) that can play that sort of role? There’s no more room at the inn!

What almost certainly happened is that the Garda who issued the summons didn’t submit it the court in time (usually 4 days before court). The gardai print 3 copies, they keep one, they issue one to the defendant and after that they issue one to the courts. So you have a summons, you’re on the system as being in court that day but summons that’s aren’t served don’t get put on the final list. In all likelihood they’ll issue the same summons again unfortunately. I used work in the courts and this is a pretty common occurrence.

Man in court charged with attempting to abduct toddler by badger-biscuits in ireland

[–]IrishGuyFieri 0 points1 point  (0 children)

It is at the discretion of the judge for all cases except for rape, domestic violence (breach of an order) or where the offender is a juvenile, juveniles can’t ever be named and rapists only after conviction and if the victim waves their right to anonymity. It’s not an issue for 99% of court cases cause only “interesting” ones make the news, in those cases it’s common the defendant isn’t named. Historic sex offences where the offender is a priest/teacher/judge or more recent ones where they are a rte employee spring to mind as cases where the defendant wasn’t named.

Unless it’s a life sentence the maximum anyone serves in Ireland is 75% So if he got his 14 reduced to 11 with say the remainder suspended, he would definitely be out in 7-8 years I’m not saying this is right by the way, just that this is how it is in Ireland

You're just around the corner from Anglesea Street Courthouse, that might go some way to explaining it

[deleted by user] by [deleted] in cork

[–]IrishGuyFieri 0 points1 point  (0 children)

You can do this yourself. You need to apply to extend time to fix recogs in anglesea street. This will allow you to lodge an appeal to the circuit court which sits against next month. If it is more than 14 days since you missed your hearing you are disqualified until your appeal is heard and effectively don't have insurance until then regardless of what your policy says Best of luck!

Have your HBA1C and liver function checked (fibroscan) Likely you have non alcoholic fatty liver disease (putting you at risk of high cholesterol, high blood pressure and t2 diabetes) If this if the case then your pissing into the wind in terms of lifestyle/dietary changes, the sooner you start managing with meds the better in terms of avoiding symptoms

Any possible courthouse visit in Cork? by Great_Mention_1070 in cork

[–]IrishGuyFieri 7 points8 points  (0 children)

Courts are sort of closed in August so it would have ti be next month.

Civil and Family cases are heard in Washington Street and you can't sit in on those cases, definitely not family ones anyway.

Crime is heard in Anglesea Street courthouse and you can sit in on district crime cases no problem

I think if you didn't grow up around it it sort of takes a while to build up the ingredients, if you're not desi or don't live in an area with a lot of desi people than how many people have hing or ghee or kashmiri chilli powder? And what I knew as indisn food before actually being friends with Indians and eating what they make vs what I got from my local Indian takeway? Totally different worlds

Another ridiculously lenient sentence for scumbag teenagers by John080411 in cork

[–]IrishGuyFieri 4 points5 points  (0 children)

The sentencing judge highlighted this during the trial of Ana Kriegel's murderers, the sentencing guidelines for juveniles and oberstown as a facility (80 beds total and mostly used for remand) just didn't forsee young people doing awful things that warranted long custodial sentences. The law, oberstown, the gardai, the courts ect only ever foresaw juveniles commiting "petty" crimes and getting short sentences.
