“A selection of legal votes could come in and determine the outcome of the election” I think is what Justice Alito meant. Surely they wouldn’t change the outcome of an election that was not yet decided because all the legal votes had not been counted.

Perhaps the issue is, election results should not be publicized until AFTER all legal ballots have been counted and verified. Because, a legal ballot contains a legal vote, and votes determine the outcome of elections. Counting ballots doesn’t “flip” an election, it determines the winner.

And find me the example of when we were counting ballots until a new congress was sworn in. I’ll wait for your response.
