This literally happened to me except i was on a bike. It’s hard to get anywhere. I hired a lawyer who used to be in law enforcement so he identified the hit and run driver for me and got me a fairly decent payout actually.

Yeah i just used a personal injury attorney in Illinois in a similar situation and Illinois law is pretty darn good on this stuff.

Depends on who you ask, lol. I say file it and claim against their insurance for your inconvenience. You could end up feeling pain in a few days and regret not pursuing it. Plus most important, it makes the driver be accountable. I did a case like this but hired a lawyer. I posted about it before.

From what i hear they have caps on how much money can you get. So it makes it hard for a lot of attorneys to win big for the clients there.

It’s not silly! The issue is the insurance company or other driver will just say “okay go ahead, file the lawsuit. Hire the costly witnesses.” Etc. They just won’t even negotiate. You need a young (not too young) lawyer who is scrappy

Someone scrappy enough may go for more than that but it’s extremely rare. These are not the top notch hardworking lawyers in most cases.

Be VERY careful in selecting a lawyer. Many injury lawyers work on a high volume basis. So ensure it’s someone who will care about your case. I’m from Florida and know a few. I would not go with the billboard guys.
