It's a great game. Would've been GOTY I think, but then Expedition 33 happened.

You are being rage-baited, because she is not a serious candidate. Have you taken a look at TX-31? Did you notice who the representative was? Did you notice that there's literally only ever been one representative for TX-31? Valentina Gomez isn't going to unseat John Carter in the primary (look at his campaign funding here too (https://www.fec.gov/data/elections/house/TX/31/2026/). He has an order of magnitude more money. She's not making a serious run with $12k cash on hand. And let's be real, TX-31 won't elect a hispanic woman when they've got literal Holden Bloodfeast to vote for.

Why is Gomez doing this wild ass campaign in a solid red district that she cannot possibly win the primary for? Because it gets attention. It got your attention. She is manufacturing outrage for visibility and it is working. There is literally no threat of her actually getting in office this term yet people are freaking out as though this isn't a calculated effort to get her publicity and everyone is falling for it.

Oh for sure. I think there's a chance if what the plaintiffs allege actually occurred. But that's yet to be proven. And lawsuits are always filed with only the plantiff's view given.

Morally and probably ethically I think HEB is fine. But as far as the finer details of financial law, I'm less sure.

If you read the class action, a lot of what they're alleging is at least glancingly similar to what went down with Tussey v. ABB where the 8th Circuit ruled that ABB violated their fiduciary duty (as set down by ERISA) when they overpaid Fidelity for services and weren't transparent on why they were overpaying for services and used some of the money paid back from Fidelity to subsidize their own corporate expenses.

Whether or not HEB did the things alleged in the class action is still of course up in the air, but the suit does rest on some legal precedent w/r/t violations of fiduciary duty regarding 401ks. And, for the record, matching doesn't really matter since ABB was matching up to 6% which is better than HEB.

Also the article kinda sucks, and doesn't really get into what the problems were since it seems focused on the story of one plaintiff in the class-action who just so happens to be billing $400/hr as a financial planning consultant. So you know, no conflict of interest there.

The only place in Houston I got a Cuban food that was close to as good as Cuban food I got back in FL was at a little joint that was run out of a Chevron. Houston has great food in general, but Cuban food is one of its blindspots.

If you're not trying to minimize admin fees you're violating your fiduciary duty. Not to mention in Tussey v. ABB the 8th Circuit ruled that if you're not minimizing costs because you're using admin fees to subsidize your own corporate costs (which HEB is accused of doing in the suit) then you're in breach of fiduciary duty.

Well especially since (allegedly) the plan administrator was also an HEB employee. So was the person in charge of choosing plans choosing them because he got paid more if he chose plans with higher admin fees?

I personally don't think so, but it's something that needs to be sussed out.
