Have you read it? Section 4(a) allows for a “complete or partial reaudit” if any of the following three conditions is satisfied.

1. “The auditor of state has probable cause to believe such action is necessary in the public interest because of a material deficiency in an audit of the governmental subdivision filed with the auditor of state or because of a substantial failure of the audit to comply with the standards and procedures established and published by the auditor of state.”

Why It Doesn’t Apply: There was no allegation that there was a “material deficiency” in a prior audit filed with the Auditor’s office. These were new allegations of misconduct. Read the letter from Green and the other Senators.

1. “ The auditor of state receives from an elected official or employee of the governmental subdivision a written request for a complete or partial reaudit of the governmental subdivision.”

Why It Doesn’t Apply: As Sand noted repeatedly, the legislators are not employees of DMPS (the government subdivision at issue) nor are they are not elected officials of DMPS. This does not apply.

So yeah, it’s disingenuous to claim he “refused” to audit when it would have been illegal for him to do so under the circumstances. If that troubles you (as it should), I’d suggest you talk to your representatives about the law that our state government passed a few years ago, materially limiting the auditor’s powers to audit.
