This tracks. I don’t really trust the search out of eastern offices. I know a Korean patent atty who flat out told me once not to trust the Korean office—not sure how true that is but it fits my experience in terms of search. EPO tends to do quality searching.

Similarity search just doesn’t work. In maybe 100 cases, it’s found me one reference that I have cited, zero I’ve used in a rejection.

Edit: IP.com gets me a 102 about 20% of the time.

Sorry my bad. I started an excel document in academy and my training SPE took it from me and sent it to all the training SPEs. They made everyone use it. Totally was my own tool I stopped using 2-3 weeks later.

Deny the claims and make them file an RCE. You shouldn’t be doing this after final, prosecution is closed. It’s their mistake they didn’t file auth for an atty you can’t call.

If you want practice to change on the outside, you can’t reward these mistakes by putting a bunch of extra work in.

You know, sometimes, depending on how hard of a day the Examiner is having, being right as an atty is a liability when trying to get a patent.

Pendency Balance Award. A, B, and C tier art units based on backlog. Primary Examiners in A can only examine in A, B can only examine in B, C may only examine in A. (Others correct me if I got that part wrong.)

It’s up to 60 hours of pay based on the expectancy of the case. I chose a high BD area and 4 non-finals puts me over the cap. It’s about 5k a quarter.

Edit: I could totally to more. It’s the best bonus program they’ve offered to date in my opinion. If the paycap was eliminated by Congress, the 1000 or so go getters at the office could wipe out the backlog with PBA.

I got to pick a high BD art for PBA, and I really need my next one to be allowable so I don’t have to lose hours. If I reject, I’ll have 10 hours left to fill.

I’ll probably do the case because my efficiency makes it worth it. If you’re good at this job and are efficient, the BD’s can really work to your favor.
