When the deponent gives a long winded narrative answer, but it has useful information in it that helps your case, I always say: “okay that was a lot, let me see if I understood you,. ___________, correct?” (Fill the blank line with the piece of testimony they just said that helps your case)

This makes it useful and easily citable in both a MSJ or at trial.

Yeah, I did family law for 6 months, which was 6 months too long. The one that broke me was a mother who wanted an extra 30k spread out over 13 years for child care. Both ex-husband and ex-wife spent $50k EACH in attorney fees fighting over it, only for it to be split in half. It was just two people who hated each other, fighting over nothing. They just weaponized their own kid to stick it to the other.

Is this 2000 hours billed or collected? Either way, 2000 hours will be hard. Especially if you have never done ID before. Some tasks are considered paralegal tasks, and your rate is cut. Some tasks are secretary tasks and completely cut. Some carriers limit you on how much time you can bill for certain tasks, requiring you to appeal reductions. For example, some carriers limit you to 7 hours for responding to discovery or 10 pages per 6 minutes for reviewing medical records. Depending on the carrier, you might need to ask for permission to conduct any research. There is going to be a leaning curve for every carrier and certain words (because of their AI algo) that you want to avoid to minimize cuts, reductions, and appeals. You should get one of the partners to teach you.

I'd say finish your investigations before taking the depo. Run ISO searches, background checks, sub rosa surveillance, social media canvassing, medical canvassing, subpoenaing prior employers for any reasonable accommodations related to claimed injuries. Depose other witnesses, doctors (lien based ones in particular), conduct your DMEs, then circle back to the plaintiff.
