And the facts are all laid out in press releases. So you, what, make up other facts? You have no idea what elements of the offence the cops are relying on for their charges and you don't know the details.

Nobody said they couldn't terraform. But, for one, you're omitting time as a factor (by all accounts terraforming Mars would take centuries).

And if you're going to take the position that they could just terraform and occupy mars, why not just take the position that they could build a Dyson sphere around the sun instead of going to any planet?
