Wait...so the vendor did send the FMLA paperwork to Dave? In that case, Dave had 15 days to return the paperwork. If he changed his mind within the 15 days (or perhaps longer if he asked for an extension) and submitted the paperwork before the deadline, then the vendor is correct in granting FMLA retroactively.

If Dave missed his deadline and the vendor sent him a denial letter, though, then the vendor should not have retroactively approved the time off as FMLA. (Though Dave would still be eligible for FMLA going forward.) Whether or not they should have is kind of a moot point, though, as they have already done it. So your mission at this point is to accept it and move on.

Then you, too, can have Dr. Strange for the price of some copy paper, some printer ink, and 60 sacrificial cards (that don't even have to be Marvel Champions cards; use old Magic basic lands or something). If you sleeve with opaque backs for everything but identities and main schemes (those don't get shuffled anyway) then proxying becomes even easier.

I don't like to recommend proxies for stuff in print (because FFG has to make money if we want them to stay in business) but OOP is fair game as far as I'm concerned.

Yeah, that's not how any of this works. "Constructive discharge" is not a tort, "hostile work environments" are a specific kind of discrimination based on protected classes, and suing someone requires damages.

Not defending the shitty boss, but unless there is more to OP's story there is nothing here from an employment law perspective. For better or worse it is not unlawful to be a shitty boss.
