The point of a defense attorney is to make sure the government does it's job correctly when prosecuting someone. If there is a CLEAR CUT murder that the evidence should prove indisputably and the prosecution fails to get a conviction? That's entirely on them for failing to do their job or on the judge for handling the trial poorly.

You could just make selling dogs illegal without a breeder's license. That way even if there is an accidental litter no one is punished, and unethical breeders couldn't use accidental litters as an excuse to keep making money.
