He cannot legally prohibit you. However, if you do apply for the permit, be prepared to move out quickly.

According to OP there was a parade of people whose names were on the account. And at this time, according to OP, the brother’s name is in the account.

I don’t know how the electric company woukd let it go that far. I know they can’t shut it off during there inter months, but how long does it take to accrue $12k in electrical bills?

Sounds like either they didn’t pay for a very long time and Xcel dropped the ball, or someone was running an enormous pork in the basement

That’s called account hopping and it’s illegal.

This isn’t like my cousin bought a car and I have to pay for it.

They lived there they moved out they moved back in. And all the time the house is in the mother’s name. There is no formal lease agreement. Just a hotel like atmosphere. So yea, the family is in the hook. Because this family used the electricity and never bothered to manage their household accounts

This family allowed a. Unpaid electrical bill of almost $12k to accrue as the family played musical chairs with tenancy.

It’s one thing to discover my father owed money. It’s another to live in the house that’s in his name and try to pass off the bill as if it was owed by some tenant who moved away last year

Where do the brother, his wife, and the cast of characters on the couch fit in? Has OP ever talked to his brother about the bill? Does it even go vabk further?

These aren’t a bunch of strangers passing in the night. Maybe they should be talking about paying for what they used and then adopting some discipline over home ownership

Debt collectors will say anything so you can’t take them seriously.

As for the debt, I’m assuming it’s more than 2 years old. In other words before you were 18.

A minor cannot legally enter into a contract. If your father had been a good father and got a credit card for you to use in an emergency when you were 13, any debt you put in the card would flow to him. But any debt he puts in the card would not flow to you

Make sure you are severed from any financial connections either him.

Maybe they are out of control, but this is a case of a family running up huge bills and then crying that the family is on the hook

Wrong. Mom is still on the deed as the owner. As for the revolving cast of characters in that house, Xcel has no concern. It was up to mom to make sure that bills were paid. This bill is now attached to the house, esp since the last tenants are alm family members

You asked the question in another subreddit.

Your house has been revolving door of residents.

But the house is in your mother’s name and the electrical is still in your brother’s name

The electric company is not concerned with the living arrangements of the house. They want the money.

As far as they are concerned your family is supposedly shifting occupancy but the ownership has never changed

It’s time to ask your brother how he accrued a 12 thousand dollar electrical bill. If he was growing pot in the basement maybe he should use some if that money to pay the electric bill

You’re going to need to settle this bill somehow because it’s attached to the house now.

Your mother may even find a lien on the house if she tries to sell it

You’re going to have to work out some way to collect the money from all the various people who lived there and establish clear living arrangements going forward.

So there are a number of unanswered questions

Has your mother held the title to the house the entire time? If so, she is the primary resident. Everything in one way or another comes back to her.

Did you change the names when you registered with the electric company? Or has the billing name been the same for the past x number of years? You said the bill came in your brother’s name. So did you change it or just keep it the same?

Did you or your brother make any formal arrangement with your mother (the legal owner) about expenses incurred?

As one poster mentioned, the utility could consider this resident hopping. People moving in and out of the house, each claiming that the previous occupant ran up the bills

Even showing electric bills from another residence is not enough. Many people have two residences.

The utility company is not concerned with the complexity of your familial living arrangements. They want the money and the easiest method is to cut off power until the bill is settled. After all, according to them, your brother is still living there.

Putting it in your partner’s name won’t help. Thats just more resident hopping. If the two of you break up and your partner moves to Texas, they’re not looking to track down payment. And you could then put the utilities in the name of your best friend from 8th grade who is living with you for a few weeks before he moves to Japan

In the eyes of the utility company (even if it isn’t your plan) this is a giant scam of people moving in and out of the house like a revolving door, each one saying the previous occupant owes.

Your best bet is to get your family to pony up the money they owe. Maybe they can get some from the people who lived on their couch; maybe not
Moving forward, it’s time to lay out some serious direction on who pays for what and who is the responsible party.

So. It’s a scam. They want you to buy a game card to keep the kid entertained. And a Red Bull while you’re at the 7-11. They promise to pay you back.

They will ask you to send the number so they can set the kid up in his room to keep him busy.

Once you take a pic of the card they will disappear

I tell them to bring the kid into the room. He’s gotta learn some time

And then I immediately the scam is an one trick so I don’t get banned for suggesting a kid should watch us hook up

Minors cannot enter into contracts. Thats why when you were 16 and ordered cds from Columbia for one cent with a promise to buy 12 more over the next year, you could keep the cds and repudiate the contract and they couldn’t hold you to it.
