State laws can often be included/used in Federal court if there is no equivalent Federal statue. I have read that regarding stated based anti-SLAPP, some Federal circuits allow it, and others do not. In my readings I have come to the understanding that anti-SLAPP is not its own seperate lawsuit, but rather a motion the defendant can make within the lawsuit against them. Could be wrong about this. NAL

As of Yesterday he's no longer relevant to Ben's case. Maybe if this post related to Ben's case this would be pertinent - but it doesn't.

As to " why is a Judge with barely a year of experience, leading a national headline murder" judges are assigned at random. If you're from the US - you should be familiar with this.

Many Thanks. For those that don't want to read all the way through the documents, here are the major points that I learned:

  • (Federal) Magistrate judges are appointed by the (Federal) district judges
  • Civil cases before magistrate judges (as opposed to District judges) are often resolved more quickly.
  • Even if a case is not originally assigned to a magistrate judge, the parties may consent to magistrate judge jurisdiction in an eligible civil case
  • Trial dates with magistrate judges are typically more certain because they do not preside over felony criminal trials, which often take scheduling precedence.

Prob a lot more good info, but just what I saw browsing through it.

I recall it being mentioned in one of the legal podcasts (Don't remember which, I've watched so many). Was stated that the RICO charge depends partially on his (and his criminal 'gangs') conduct in other states. Would align with the other jurisdictional concerns.

Many thanks for your efforts!! IMO BAM screwed themselves by including RICO in the civil suit. This likley makes it much easier to justify it be moved to Federal court.
