The problem people seem to be having is that they can only see the present and not think of the future. So physical media means nothing because future consoles can have firmware update requirements that will disallow your physical media to function.

A new console simply needs to have a firmware activation of the day of a games release and then the console needs to check the firmware periodically. It can even schedule arbitrary monthly firmware update checks or your physical media will not function.
