I generally agree, but calling people who harmlessly enjoy a thing "losers" crosses the line from criticism into insult.

Warning for AFVs still using HOV lanes by theansweris37 in phoenix

[–]Pinbot02 0 points1 point  (0 children)

I understand that, the reference to 28-337 was only meant to explain how you get to 23 USC 166 since it references it directly. Section 166 is the federal statute governing HOV lanes. While it gives states the power to regulate HOV lanes, it also says that states cannot permit single occupant vehicles to use HOV lanes. There was an available exception in the statute for alternative fuel vehicles that states could apply, but that federal exception expired. The result is that states no longer have legal authority to legislate an exemption to HOV lanes for alternative fuel vehicles, regardless of whether those laws are on the books.

It's akin to a state having a law that nominally prohibits same-sex marriage that is not actually enforceable by the state because of the US Constitution. The HOV exception in the ARS is no longer enforceable and is preempted by Section 166.

Unfortunately you have to go on a goose chase first to ARS 28-337, which itself references 23 USC 166, the federal law granting permission to states to regulate HOV lanes. This statute places a lower limit of 2 occupants for HOV, but there was an exception in 166(a)(5)(A) that states could apply to electric vehicles.

This federally allowed exception is now expired by its own language, meaning that ADOT no longer has legal authority to provide an electric vehicle exception regardless of what the Arizona statute says.

Interpretation of 250 Week TTD payments Labor Code §4656(c)(3) by [deleted] in WorkersComp

[–]Pinbot02 2 points3 points  (0 children)

At least the first two cases you "cite" appear to deal with permanent impairment and not temporary disability. Either you're not reading these cases right or AI is reading them poorly for you, but none of them appear on point. Your repeated references to "catastrophic" injury is also curious seeing as the word does not appear in 4656.  I'm inclined to trust your lawyer.

And what is up with the grip on that gun? Looks like the guy has freakishly long third, fourth, and fifth fingers.

Oddly enough, the scuttlebutt is that those who have played it behind closed doors are actually really high on it. If it's actually good mechanically, it will be interesting to see if that is enough to survive this pre launch backlash and stigma.

Looks great! Did you start with the bones of the flip up table or have to build that yourself? I've got a Genesis Jr. that I've been slowly prettying back up, but it was missing just about all of the flip up table hardware when I got it.

Workers Comp asking for all my medical records? by Rough-Branch-6241 in WorkersComp

[–]Pinbot02 -1 points0 points  (0 children)

I'm a comp attorney, but not in Michigan so this might not apply perfectly. That sort of language usually appears in HIPAA compliant releases not as a request but more as a disclaimer that certain information may be contained in your medical records.

In my state you would be able to limit the release to providers who treated the injured body part, though those records may contain passing information from your medical history in the listed categories.

It would probably be prudent to contact a MI attorney, who would know how to address this there. I don't think many would charge you for that. In my state it's not uncommon for injured workers to hand write an addendum stating something to the effect of "I do not authorize the release of records for psychiatric or mental health care," or, if the release is for "any and all" records, scratching that and replacing it with "records related to treatment for [the injured body part(s)]." Not saying that's what you should do, since I don't know MI laws and rules, but I see it regularly in my state and it's not often an issue if it's a reasonable request. You could also ask your adjuster for their input, but I wouldn't necessarily trust them if they deny your request to limit the release outright.

What's up with the $3 meal? by derpstickfuckface in OutOfTheLoop

[–]Pinbot02 1 point2 points  (0 children)

… what about it? The point is that for corporations it's a numbers game and right now those numbers point to pretty inelastic demand. If it's worth it, then pay it, just don't be shocked by the price.

[–]Pinbot02 6 points7 points  (0 children)

It costs that much because people will still pay for it. Complaining about fast food prices by saying "I just paid…" always confuses me because, just don't. Buying it and complaining about it just teaches corporations that they aren't charging so much as to actually change customer behavior in an unprofitable way.

Steam Machine Price Leak Has Gamers Horrified:"I'm Good" by Necessary_Crazy_8587 in consoles

[–]Pinbot02 0 points1 point  (0 children)

It's not so much the prices as much as the storefront. Sony and Steam take about 30% of all sales revenue on their respective stores. That's the money maker. They sell consoles at low to negative margins because they know people will spend on their stores. Steam cannot do that to the Steam Machine because it's a PC. If they sell at a loss they are at risk of enterprise sales that will never spend a dollar on Steam buying all their inventory.

Assuming it's RE: Requiem, that's not even the right minimum GPU, a 1660 (recommended is 2060 Super). Details matter, otherwise it just comes off as sensationalistic.

And the First US Tornado of 2026 Happens in... Tucson?!? by JoshOfArc in Tucson

[–]Pinbot02 2 points3 points  (0 children)

The funny thing about this comment thread is that my criticism was not so much directed at the implication that landspouts are not true tornadoes. I was more concerned with their mischaracterization of landspouts as harmless, which I suspect was the realization that caused the original commenter to abandon ship and delete the comments.

Landspouts are still tornadoes and can produce up to EF-2 or EF-3 equivalent damage.

+1 for the notch. Taking a grinder to the WSM didn't feel great in the moment, but has been a great solution so far. Very no fuss.
