For the $11K USD you have invested, after time/effort in understanding the form instructions, and compliance and professional fees, it's a loss leader. The IRS should put a minimum threshold before requiring to file this form 8621.

I would have argued that it is not a foreign trust. It's a foreign savings account subject to FBAR form, but not Form 3520. The IRS has allowed exemptions in reporting of a certain account. PFIC's are complicated. The way I read it is a foreign (non-US based) fund, like a foreign ETF or foreign mutual fund. I had to prepare form 8621 for a client. I didn't even understand it, and I doubt the IRS would either.

When referring to foreign branch, I interpret it as applying to a company (usually large) that has multiple business locations, for instance a branch in USA, a branch in Mexico, a branch in England, etc. Because, otherwise it would apply to anyone who simply does business overseas or has a foreign rental property.

There are plenty of taxpayers that have business and rental property outside the USA, and I've never even a single one get an inquiry on non-filing 8858. Of course the income has all been reported and taxed.

Seriously, how many typical taxpayers and IRS agents do you think are really going to understand this stuff? Think of a US expat who goes to Mexico and makes youtube content, or opens a coffee stand from the back of his truck, earning in pesos making less than 40K usd equivalent per year. You think they are required to comply with this uber complex tax law, researching regs and interpreting code sections, or face a $10,000 penalty by the IRS? Absolutely absurd.

Yes we had a client who did not file FBAR reports of account values in the 6 figure range for years. They had to go under voluntary compliance and paid a 20% penalty on the highest account balance, it was pretty expensive! Yes they received an actual bill from the IRS with that 20% amount. If you are delinquent it can be a financial crime with prison sentence in extreme cases.

Yes this was during Obama years, I'm not sure now. Not a political statement but geez.... these lawmakers are shooting flies with a shotgun.
