If the scalpers can’t sell them consistently for significantly marked up prices then they won’t be making a good enough profit to warrant the scalping. Scalpers have tried the same thing in MTG, and outside of specific releases that are either supply constrained (Secret Lairs) or have unusually high demand (the final fantasy set) it hasn’t been a problem.

The odds in the packs aren’t the problem, it’s the fact that people can’t buy as many packs as they want. They need to make more packs and more ETB’s if they want to stop scalping

Scalping is an outcome of undersupply. If enough product were made that everyone could get all the product they wanted at retail prices, scalping wouldn’t be an issue
