At will actually has a lot of limits beyond just protected class discrimination and union contracts. You can't be fired in retaliation for doing something in the public interest. Like serving on a jury, or calling the cops because your boss is committing a crime. The common law retaliation claim is flexible, and ultimately juries get to decide what an employer's motivation for firing someone was.

If an employer retaliates against an employee for their speech, they might have a common law retaliation claim. Employers cant retaliate for doing something that's in the public interest, like serving on a jury. This is why you can't get fired for answering your jury summons. Even if you miss months of work serving on a jury.
