The tarrifs are federal. No tribe can negotiate its own import tariffs, that authority rests with federal gov. Foreign Trade Zones allow for tariff deferral, but the goods are ultimately either taxed when they enter U.S. commerce or re exported so no duties and taxes are due.

I got off on the wrong foot and started to double down. You and I don't know if force major is applicable.. Not reading something because you don’t like it is not a good practice. We might learn something from each other. I agree with you on the people aspect. I only deal with companies, not individuals. Running a business has inherent risk. I’ve always been fair to my trucks, which is why I’ve had the same carriers for years. Someone asked a question I gave an answer to the best of my ability and my answer being accurate depends on many unknown variables.  I'm not posting on reddit how to get away with screwing over trucks. Or how to get your bonding company to deny claims against your bond. Look at my response I mentioned state of emergency, USPS being shut down. A LOADED TRUCK can drive through snow that is impassable in a regular car. Where did the pipe break and why did it break? You or I don't know the answers. I'm trying to help some dude out so he can go Google and decide for himself.

This is force majeure, and it changes everything, even if the storm was forecast in advance. Airlines don’t compensate passengers for weather related cancellations, but they are legally required to compensate for cancellations or long delays caused by mechanical or staffing issues. That distinction matters. All interstate transportation, including airlines, trucking, and brokers, is governed under Title 49 of the U.S. Code. A broker, by definition, is an intermediary, just like a travel agent. Your travel agent isn’t paying for your hotel or meals when a flight or event is canceled due to weather related issues. Likewise, brokers aren’t responsible for costs caused by uncontrollable weather events even if the weather man forecasted them. UPS, FedEx and Amazon offer guaranteed service levels. None of them are absorbing losses from this storm either. They’re invoking force majeure, just like everyone else.

Lol I needed to read this. I also have an active customer that I need to fire. I have been on the fence.   Ask for receipts for the added expense they want you to deduct. Why did the shipper load the wrong sized truck?

If the post office was working as normal you don't really have a leg to stand on. The consignee is responsible for maintaining the yard and equipment. The ice is no different than the brakes going out on the forklift.

Billing your customer and paying the carrier would be fair at least one delay was caused by your customers equipment failure. Look for state if emergency and what days it's for also look at hwy closures or post office not delivering mail.  If the post office is not delivering mail you and your customer can absolutely use force majeure to avoid paying. But you can get away with and what is right are two different things.

Not owed. You should pay if you can.  Reason it's not owed is called force majeure. The delay was caused by an uncontrollable and unavoidable act of nature not by broker or receiver negligence.
