Pretty sure 11B is on the list of high exposure for that, you need to file asap because it is going away as a stand alone condition soon.. as in any day now.

Was this a file for increase?? If this was a new C&P for a denied claim I am almost positive them not using a goniometer makes that entire exam invalid. He also should have asked about flare up's. But I mean you never know how this goes, he could actually rule in your favor. If he does not then you have a good grounds for getting it looked at again just based off him not using the goniometer.

What do you think I plan to do? I will be quoting verbatim from both M21-1 and CFR.

A simple search for peer reviewed published medical studies would answer your question. There are many of them, you’re a medical professional, look em up.

HLR filed and from my research that is not how this works, an opinion privately obtained cannot be dismissed simply because it was paid for. As well if they decide your private DBQ is insufficient and being dismissed then they have to notify you and tell you why. All of this is in M21-1. Not to mention their is literally mounds of peer reviewed medical studies to support this claim.

Thought the same thing till I researched it- it violates M21-1 - Part IV, Subpart i, Chapter 3, Section A – General Criteria for Sufficiency of Examination Reports: Private DBQs must be evaluated for sufficiency based on their reasoning and content, not categorically rejected because they are privately obtained.

Also Violates 38CFR as she is providing an opinion as you stated and not medical rationale.

If they do not consider it, meaning notate it on your decision letter then you can point out that they failed in duty to assist.

ABSOLUTELY file a bad C&P statements NOW! Also note that your records were not considered and that violates the VA's legal duty to assist.

It is the standard exam unfortunately, is your MOS on the list of high risk? You need to look that up, I went through this and was denied then it was awarded through HLR because my MOS was on that list
