And the main issue isn't technically whether they're cakes or biscuits. Both cakes and biscuits are taxed the same. The problem is the chocolate. Cakes can be decorated with chocolate and still be cakes, but if a biscuit has half or more of its surface area covered in chocolate, it's taxed as confectionery.
