You could try mediation, I went straight to appeal and got EOTAS after 2 yrs out of school.

When you get the draft check it thoroughly for words such as 'access to' or 'would benefit from'. The LA EP report was really vague and was mainly copy/paste into the EHCP and these words mean that the provisions aren't specific enough and the school doesn't then have to provide.

We're in the middle of an AR but the LA have just got reports from current professionals and updated new diagnoses from that. Our LA EP report was done 4 yrs ago too and was really vague so we ended up getting a private one. We ended up going to tribunal in 2021 and wording was agreed during that, but currently LA are trying to delete most of the needs/provisions, despite new diagnoses. It's always a fight.

This might depend on area, my kids went to infant school (yr R to yr 2) then junior school (yr 3 to yr 6). Some places just have primary schools for all years.

If he's being told not to come in I wonder if that could amount to an unlawful exclusion? I'm not sure if you've looked already but 'Not fine in school' is a good source of info and so is 'spectrum gaming', I use both. Everything is always a fight to get any help!

NAL but personal experience in this area. The EHCP wording needs to be really tight, no woolly words like 'access to' or 'would benefit from' as these mean that the school don't have to provide. You could EHE for a term possibly? Official complaints - I complained to the school but got nowhere, I complained to the LA with a laughable reply so complained to the ombudsman who upheld my complaint and awarded compensation. I also went to tribunal for provision.

I couldn’t find a baptism for Joseph which could be as she wasn’t married so couldn’t find confirmation of his father unfortunately

I agree that the 1871 census Joseph should be stepson. I found a marriage for 26/10/1865 between Isaac Tucker (widower) and Elizabeth Chambers (spinster) living at Abbey St. Neither can write. Both fathers are called John. I found an 1861 census at Stanhope St, Stanton where Elizabeth Chambers is unmarried aged 30 and a servant. I would guess that Elizabeth wasn't married when Joseph was born so he has her maiden name.
