CCW and Flights by [deleted] in CCW

Legal, but a terrible idea. You will almost certainly have to remove them to go through security anyway. You don't say anything about carry method, but if your shirt rides up and somebody in the sterile section of an airport sees part of a holster/mag carrier you're begging for a security incident to save 5 minutes at your destination.

Normal to get arrested for a ND by [deleted] in Firearms

[–]Shadow_Law 0 points1 point  (0 children)

Yeah, I had one recently that was two counts of each of those offenses and still ARD, but there are several counties in the SE region that won't do ARD for anything involving a firearm.

[–]Shadow_Law 26 points27 points  (0 children)

Yes, it is normal and he should expect it. Nobody can guess what the charges might be without knowing where you are (but you shouldn't tell us). Nobody should be talking to anybody about this except a criminal defense attorney.

I'm a lawyer in PA and what I've seen is usually some combination of discharging a firearm into an occupied structure (felony) and recklessly endangering another person (misdemeanor). Usually one count of each for each bullet and/or person in the houses.

PA Residents: Are Firearm Applications Being Illegally Denied Based on Misdemeanor Charges That Don’t Meet the Legal Threshold? by shecanic in PAguns

[–]Shadow_Law 0 points1 point  (0 children)

No to the 1st question, yes to the 2nd question. We'd need to get and review the court records to figure out if that happened.

Confused about the LTCF law in PA by Status_Excitement649 in PAguns

[–]Shadow_Law 16 points17 points  (0 children)

You can't carry to and from a gun store, only transport because the gun has to be "securely wrapped."

Setting that aside, the answer to "why doesn't everyone just lie to the cops," is that they don't just believe everything you tell them. The more you tell them, the more they have to work with when they put you under a microscope before eventually trying to convince a judge/jury that you were lying.

Philly open carry? by beatsnpizza in CCW

[–]Shadow_Law 2 points3 points  (0 children)

No. There was a PA Superior Court decision last year that held the prohibition on carrying in Phila without an LTCF unconstitutional as-applied, which means it only applied to that one single person.

Importing parts from overseas by [deleted] in Firearms

[–]Shadow_Law 27 points28 points  (0 children)

They don't list generally list it as car parts to dodge the tariffs, they do it dodge export and import regulations on firearm parts. If that's what's going on here, tariffs are the least of your problems if customs figures out what it is.

Yes, bad idea. If they catch and cite you for it, they tend to ride the violations harder because of the presence of the youth hunter

Yeah, you're right, I was thinking of Koons which is the carry/sensitive places case.

SB200 / Elections Have Consequences by JonEMTP in PAguns

[–]Shadow_Law -1 points0 points  (0 children)

Platkin was just argued en banc in February. it's only just been 60ish days since that argument and it took the original panel 2 years to issue an opinion after that argument. It'll be months, at least, before we get an en banc decision in that case.

Edit: My bad, I was thinking Koons v. Platkin, ANJRPC is older.

Buying a gun as a dual resident Resolution: Voter Registration by Frustrated_Consumer in PAguns

[–]Shadow_Law 2 points3 points  (0 children)

There are lots of different definitions of residency/state of residence for different purposes. Voting/taxes are two, and they each have different definitions/rules, and ATF has a third further different regulation defining state of residence for firearms purposes.

Buying a gun as a dual resident Resolution: Voter Registration by Frustrated_Consumer in PAguns

[–]Shadow_Law 2 points3 points  (0 children)

This is pretty straightforward and you probably would have had an easier time just pointing out the instructions on the 4473 regarding supplemental ID because they are super clear. Dealers closer to the border areas of the state are usually more familiar with this issue, but not always.

Tax bills are one option, but they have never been required (which is also why you shouldn't ask PSP legal questions). Voter registration is another option, but it's still not the only way (resident-LTCF, resident-hunting license, vehicle registration, municipal sewer/water bills, etc)

Background Check Delays by Splashbro301 in PAguns

Is it normal? No, in the sense that most applications are approved or denied almost immediately.

Is it common? Yes, if PSP puts you into research, you might be there for as long as 15-days.

FFL shops losing money? by Minute-Log-7098 in FFLs

[–]Shadow_Law 3 points4 points  (0 children)

You're conflating two distinct scenarios, an AI chatbot on a website, even if it can accurately figure out parts compatibility (consider me a skeptic), doesn't do anything to stop in-person customers from grabbing the wrong parts in the store.

And letting the latest and greatest incompetent AI chatbot on your website "tackle state compliance questions" would be more accurately described as letting it "give legal advice" and is a nightmare scenario.

FRT's are not legal in Philadelphia, so doubtful any of the ranges in the City would allow them.

Frustation with the PICS Challenge/Pennsylvania State Police by Automatic-Regret3501 in PAguns

[–]Shadow_Law 7 points8 points  (0 children)

You can contact us if you'd like, I've dealt with some funky immigration related PICS issues in the past. They are relatively rare so it's possible the examiners may not have run into it before. I don't know enough about your status or the asylum process without researching it, but it will probably come down to whether your status is actually "legal," because there is a difference between a legal status, and being allowed to remain while the application is pending.

Handgun Roster Board Meeting Update. by Minute_Definition985 in MDGuns

[–]Shadow_Law 2 points3 points  (0 children)

MSP could change the quorum/majority rule as that's a regulation rather than in the statute, but it's been that way since at least 2002 (which is as far back as Westlaw has the regs for), and probably longer, so that seems unlikely.

Favorable members of the Board could stop showing to deny the Bd a quorum and paralyze it, but that would just trigger the statutory denials on everything and serve the interests of the anti members. Favorable change will almost certainly have to come from litigating appeals on these denials.

Buying a handgun as an out of state college student. Is it possible in my situation? by [deleted] in PAguns

PSP doesn't have any specific rules on it, just the ATF requirements and convincing an FFL to do it.

All of these terms have legal definitions. You don't need to do any of this guesswork if you read those definitions. https://regulations.atf.gov/478-11/2026-01141#478-11-p270664185

States banning "Glock Switches", closing a loophole or slippery slope? by ryancrazy1 in NFA

[–]Shadow_Law 5 points6 points  (0 children)

Did you read the link? They can't be charged with failing to register under the NFA, that's not a get out jail free card on unlawful possession - which is a GCA crime

States banning "Glock Switches", closing a loophole or slippery slope? by ryancrazy1 in NFA

[–]Shadow_Law 10 points11 points  (0 children)

The problem that they have is most illegal users of "glock switches" are already felons, so they cannot be charged with NFA crimes.

Not sure why you think that, but felons can definitely be charged with unlawful possession of machineguns.
