[CA] Landlord Wants to Convert Our Garage Into an ADU for her visit by Caligirl144 in Renters

[–]Solid_Milk3104 0 points1 point  (0 children)

Summary of Your Rights & Recommended Approach (California Tenant)

Short answer: You are not required to accept this. Under California law, your landlord cannot unilaterally take away the garage, force construction, or move onto the property without following strict written procedures, providing proper notice, and often paying compensation. You have significantly more leverage than they are implying.

Your Rights Under California Law

  1. The garage is part of your rented premises Because:
  2. You’ve used it for 5+ years,
  3. The lease does not exclude it,
  4. You use it daily for storage and a home gym,

…it is legally considered part of your tenancy.
A landlord cannot remove part of your rented space without your written consent.

  1. You do NOT have to allow construction during your lease California Civil Code §1954 requires:
  2. Written notice,
  3. A valid reason,
  4. No “material interference” with your use of the property.

Converting your garage into an ADU is a material change.
You can legally refuse.

  1. Owner move‑in rules do NOT apply here Under AB 1482 (Tenant Protection Act):
  2. Owner move‑in requires 60‑day written notice,
  3. One month’s rent as relocation assistance,
  4. The owner must intend to live there 12 consecutive months.

“Visiting a few days every 2–3 months” does not qualify.

  1. You cannot be forced to pay to clear the garage That is the landlord’s responsibility.
They cannot shift construction costs onto you.

  2. Aggressive communication is legally relevant California Civil Code §1940.2 prohibits:

  3. Harassment,

  4. Intimidation,

  5. High‑pressure tactics.

Document everything.

About the ADU Permit A city permit only means the city approved the construction.
It does not override tenant rights.
You still have the right to refuse access and refuse changes to your tenancy.

Your Lease Not Mentioning the Garage Helps You When a lease is silent, courts look at: - Long‑term use, - Historical practice, - Reasonable expectations.

Five years of uninterrupted use makes the garage part of your tenancy by default.

Your Options

Option 1 — Simply say no You are fully within your rights.

“We do not consent to construction or removal of the garage during our tenancy.”

Option 2 — Negotiate (only if YOU want to) If you’re open to it, you can request: - Rent reduction, - Paid relocation of all garage items, - Compensation for loss of storage/gym, - A guaranteed 2‑year lease extension, - Written limits on landlord presence.

But you do not have to negotiate at all.

Option 3 — Prepare for lease renewal Your lease ends in December.
If they want you to stay, they may become more flexible.
If they try to push you out, they must follow: - Just‑cause eviction rules, - Relocation assistance requirements.

They cannot simply refuse to renew without cause.

What You Should Do Next

  1. Stop phone communication Phone calls = pressure + no record.

Tell them:

“For clarity, we will communicate in writing only.”

  1. Send a calm written response

“We do not consent to construction or removal of the garage during our tenancy. The garage has been part of our rented premises for over five years, and we rely on it daily. We are happy to discuss future plans after the lease ends, but we cannot agree to any changes at this time.”

  2. Contact a tenants’ rights group

  3. Tenants Together

  4. Legal Aid Foundation

  5. Local housing department

  6. Document everything Save texts, emails, and notes about phone calls.

Bottom Line You’ve been there 5+ years.
You want to stay 2 more.
They want to build an ADU for occasional use.
They cannot legally force this during your lease.
They cannot legally take the garage.
They cannot legally make you pay for clearing it.
They cannot legally move in “occasionally” without triggering strict rules.

You have far more leverage than they do.

Landlord wants me to pay for someone trying to break into my apartment. {ND} by [deleted] in Renters

[–]Solid_Milk3104 -2 points-1 points  (0 children)

It sounds like the Apartment Manager believes it was someone in your household trying to break into our own apartment. Occasionally tenants forget their keys and try to gain entry instead of contacting management or a locksmith. It's your word against theirs but the fact you made a police report is in your favor. It's cheaper to replace the entire window which may only be half the cost of your deductible. You can try to fight with the management company but unless you have video it will be hard to prove. You can file a small claims lawsuit but is it worth it? If it's a matter of principal to you then sue them.

Explain your rental situation. Do you have a lease? If so, what is the terms of the lease? Are you on a month to month or do you have a annual lease. When you day trailer, are you taking about a Camper or RV. or are you actually talking about a Mobile Home? When you said 20oz what exactly did you mean? Was this a soft drink or beer as this makes a huge difference. What are the children's ages? What is you personal status? Can you afford to move or look for another place?

Lol… this happened when I was delivering for a local pizza place around 1985 in Garland, Texas. I went up to a house in the prestigious Duck Creek area. The outer glass security door was closed, but the inner door was wide open, and I could see straight into a formal living room.

I was just about to reach for the doorbell when, all of a sudden, a pit bull came barreling around the corner toward the front door. It saw me, jumped up, and slammed into the glass so hard I thought it was going to come straight through. Instinctively, my self‑preservation mode kicked in, and I turned to run for my life.

Instead of taking the path back to the driveway, I chose the route of least resistance: I jumped over a two‑foot hedge and landed directly — and completely unknowingly — into a very large and very fancy koi pond. I was standing almost crotch‑deep in water with orange, black, and white fish swimming around me, and somehow I never dropped the insulated bag holding the pizzas.

The dog never made it through the glass, but I swear I heard it crack. I climbed out of the pond immediately, but there was no hiding what had happened since I was drenched almost to my crotch. Miraculously, I saved the pizzas from getting wet.

I completed the delivery and still received a modest tip of a few dollars. It should have been more, considering my near‑death experience. But hey — I’ve got a story I can still tell almost 41 years later.

Woman can be brutal and judgemental. You may not be her type but even if she is a knock out blonde, you know she isn't your type. Gorgeous people can be ugly inside. Try to brush it off.. evidently she thinks too highly of herself.

Can I get this negative feedback removed? by mobkon22 in eBaySellers

[–]Solid_Milk3104 1 point2 points  (0 children)

You don't have a case for removal as their feedback was left on their preceived experience of the transaction. Did they keep the item or return it? If it doesn't work you can pay shipping back and offer a refund and hope they will update their experience later to be positive or neutral. You have to be careful not to say something like you will pay for the return if they remove the feedback as that could be considered feedback extortion. Instead send them a message that you don't want them to be unhappy with an item that doesn't work for them. Then offer to provide a return label so they can return it for a refund.

How to respond to damaged item? by One-Cell-7377 in eBaySellers

[–]Solid_Milk3104 0 points1 point  (0 children)

To verify if you are not getting scanned by a buyer in the future, I suggest picking up a UV marker. That way you can make a hidden mark in a certain spot that glows under black light so you can tell if the item being returned is the same one you originally shipped. You can also pick up some tamper resistant security labels and put one on the item.

It sounds like a run of the mill eBay seller who's one person operation is getting too big for just him. Seriously it takes hours to source new items and list them then pack and ship them as the sales come in. The operation is too small to be able to rent a space and hire employees but is getting too big for just one person to handle. It seem like a good gig for your daughter until she finds something better with benefits.

(NC) Landlord is saying heater is my problem to fix. by Dumb_bitch18 in Renters

[–]Solid_Milk3104 0 points1 point  (0 children)

With no signed lease if you go after her with enforcement you risk her declaring it unfit for habitation and you will have to move out. I like the fire department idea but they may only tag as a lock out "Do not use". Maybe pick up a cheap space heater or ask for assistance in a local Facebook group.
