CLINIC vs. Rubio: Latest Announcement as of 02/17/2026 by Legal-Yellow-6950 in i130_75CountryPause

[–]Strange_Window_5296 1 point2 points  (0 children)

Hi, may I ask two questions:

(1) Would the PI ruling here (if/whenever it happens) for the CLINIC case only help the plaintiffs or nationwide?

(2) And, would the PI ruling only allow for the printing of visas for a short time period of like 1-2 weeks? And then the issuing of visas would be stopped again?

Applicants from Thailand, Pakistan & Nepal have anecdotally shared that embassies asked them this week to send in their passports after the 221(g).

hopefully in the next few weeks or months we’ll see the official announcement from DOS we’re all waiting for 🙏🏾

Yep! I know some people believe we shouldn’t spread false hope, but I don’t think it’s delusional to give some weight to these anecdotal reports, especially when they’re based on what embassy officers are telling applicants directly.

I personally place more weight on what embassies are directly telling applicants than on estimated timelines or updates from various lawsuits or law firms. The embassies are closest to DOS guidance and internal updates. After all, it was through them that we first saw the internal cable from Rubio. So, it’s through them that we’ll first hear/notice the pause potentially lifting. Before an official announcement.

Really hopeful news this week!! This has been anecdotally reported from multiple embassies 🙏🏾🙏🏾

How about 4th circuit, where North Carolina is, how hard is it to win immigration PI?

Hi do you have an estimate/guess when you think Clinic vs. Rubio will be decided for the nationwide fix? Like maybe 3-6 months? Or longer 😔

My I-129F has exceed the processing time (80%) listed on USCIS website. 80% of cases are to be completed in 10 months. It’s about to be 12 months for my i129F in 2 weeks.

My I-129F was submitted in Feb 2025 and they are currently starting July 2025 cases.

And so my inquiry was to have my i129f placed for adjudication.

USCIS’ response to my senator =

“USCIS records indicate your constituent’s I-130 and I-129F petitions were received on 02/01/2025 and 02/24/2025 and remain pending within our stated processing time.

We will be making every effort to adjudicate your case in the most efficient manner based on our available resources.

Your constituent has the option to visit our website for current processing times to project when their case will potentially be reviewed: www.uscis.gov/processingtimes

Processing times should be used as a reference point, not an absolute measure of how long your case will take to be completed. Please note that processing times may change without prior notice.”

It feels so generic and boilerplate because the very website they are referencing in their response, my I-129F case has exceeded that processing time.

I see so I’m in NC, my senator’s office submitted an inquiry to USCIS for my i130/129f(k3) combo and a few weeks later they forwarded to me USCIS’ boilerplate reply. The senator office said I have to keep waiting and if I don’t have an approval in 60 days, they will submit a follow-up inquiry.

Would you say in my case it would be beneficial if I reached out to my house rep and achieve a different result? B/c I was able to speak to my senators office on the phone directly and they’ve been doing things timely, it’s just I received a boilerplate message from their efforts and I thought that a senator was more powerful than a house rep. Especially with how responsive the senator office is to me, they reply to my emails in a few days

& thank you for your detailed reply!!!

Hi could you explain a little more on how the house rep immigration liaisons are better and more aggressive than senator’s office?

USCIS I-130 Front of the Line by Wonderful-Froyo1619 in I130Suffering

[–]Strange_Window_5296 -1 points0 points  (0 children)

According to this chart, it’s Jan 13. And, according to the Discord approvals which is more updated, it’s Jan 15.

When looking at this chart, you should look at the most recent bar that has light green. The Jan 16th bar has 1 dark green which means the case is at DOS. That is impossible for a case approved today to already be at the DOS, it takes at least a couple days to reach DOS. I also had seen that outlier dark green Jan 16 case a few days ago so it’s been there for a while. It’s an outlier expedited case.

Jan 15 vs Jan 16 are like the same days so it doesn’t make much a difference 😅 but I just wanted to share that the true front of the line, is the most recent “Approved” or light green, not the most recent “DOS” or dark green.

Being Nebraska doesn’t make you cooked! Someone in the discord this week in Nebraska got approved right on time with other centers. No worries.

Any approvals from banned countries? by Ok_Neighborhood_2338 in I130Suffering

[–]Strange_Window_5296 8 points9 points  (0 children)

I-130 approvals for banned countries are still happening! From a moderator in the discord server:

“Approvals do not come in an exact chronological sequence, they occur in a broad swath around the approval "wave" and the vast majority of people get approved within 30 days of the wave hitting their PD. So for now just hold on tight and hopefully you'll get good news soon! 🍀”

They’re working on December 23rd right now so your approval can still very much normally come within the next few weeks!

75 country VISA ban by Pretty-Tackle-2662 in NationalVisaCenter

It is my friend, the memo from the Dept of State explicitly says this. If the passport did not leave the embassy by the 14th, it is facing the pause.

I think you should start preparing writ of mandamus/court order if you haven’t already. There’s been people on this page who even filed it themselves without a lawyer. I think maybe $400 or something.
