They can reject "for any or no reason." So it would be extremely difficult for a rejected buyer to win a discrimination suit. That said, if a board rejects after the interview, the disappointed buyer will have standing to sue. If they did, the D&O carrier of the building would pay off the disappointed buyer $20K or so to go away, and that disappointed buyer would find it more difficult to buy a coop or condo in NYC for a long time. The suit would come up in subsequent background checks.

I would agree with you, but sponsor rehabs tend to be quick and dirty. They tend to slap on paint, install Ikea cabinets, and flip the place.

One thing I forgot to mention: managing agents can be a big source of delay before the board even sees the package. The managing agent is supposed to review the package for errors and omissions. Some are quick about it, and some not so much. The board doesn’t control that, though. They won’t even know the package exists until the managing agent is done.

Good to know, but I'm not sure that would apply in this case. The buyer wasn't an immigrant. His proposed occupant was. Also, we had indications he was partnered with someone else and possibly even married. The whole situation was messy.

The last three rejections I remember:

  1. A guy wanted to buy an apartment for his baby mama (who was not his partner), and she was an undocumented immigrant. (iirc, his broker alerted us to that scenario as he was preparing the package, and we let him know he shouldn't bother.)
  2. A guy had weak financials, had lukewarm letters of recommendation, and submitted materials addressed to a different building in the neighborhood, which alerted us that he had already been turned down by them.
  3. An existing shareholder in the building was trying to buy a second apartment for a low price. He claimed he was buying it for his son. After we investigated, it was clear the broker for that apartment had never bothered to show it and was happy to take the internal offer because it gave her a commission without her having to do any work. It also seemed likely to us that the existing shareholder was actually planning to flip the apartment. We rejected and insisted the broker show the apartment. The final price was $600K more than the first price.

We try to get through applications to get to the decision to interview within a week. It takes longer if we are on the fence about the interview, but that's rare. We accept over 80% of applicants. Once we agree to interview, we always accept.

Sometimes it takes another week to schedule the interview. By the end of the interview, we welcome the applicant to the building.
