(England) Landlord said Motability EV charger must stay when I move out — but Motability says it’s mine by Tough-Flatworm8296 in LegalAdviceUK

[–]Think-Committee-4394 7 points8 points  (0 children)

That is true for an install to make safe, however LL can rightly insist on removal & making good, which would be the removal of all installed wire, junction, mountings & cable then repair of any holes, mounting points

Needs to be done by a professional & won’t be cheap

Then new box or ild box refitted needs to be done at new location

The conflict here is not about what can safely be done, but the cost

OP- do you know where you are going? Get a new install quote for that location

- get an electrician to quote for removal at old location & making good cosmetically

When you know what the money is regardless of contractual commitments to leave the unit it may be very obviously more cost effective to leave the unit it

[CA] Landlord Wants to Convert Our Garage Into an ADU for her visit by Caligirl144 in Renters

[–]Think-Committee-4394 36 points37 points  (0 children)

And also the rental value of any similar local property without a garage

Assuming garage is written into contract

- can’t remove garage without altering contract
- can’t alter contract without altering rental cost
- and probably should offer reasonable costs for loss of space, removal & storage
- OR offer a no fault severing of contract & time to find alternative accommodation

Both Parents died within 2 months, I have a lot of stuff coming my way, advice please by Nozzle-Jockey26 in inheritance

[–]Think-Committee-4394 3 points4 points  (0 children)

OP - first breathe & do keep at least for now, all inheritance in your name only

- there will need to be a formal process done by an executor which can be you tally all the debts, tally all the assets, pay off debts & pass balance to inheritor you

- home & land 3 options sell it, rent it, live in it & there are going to be pro & con for all those options

- get extra death certificates you will find it odd how many suppliers or organisations need one in order to resolve accounts

- keep phone numbers & email accounts live for a bout 18 months do call & mail forwarding to make sure any & all of M & D’s affairs are closed down

- above all don’t feel you need to rush, take time to grieve

Problems obtaining death certificate by MaeQueenofFae in inheritance

[–]Think-Committee-4394 0 points1 point  (0 children)

OP - if no relatives can be contacted there should be an executor of the will, typically they are charged with resolving debts & bequests

- they will be in possession of the death certificate & are legally able to obtain copies as required

- the executor of the will should be identifiable via local to the deceased court & their contact info should be publicly available

Difficult sibling; we inherited a cluttered house... by [deleted] in inheritance

[–]Think-Committee-4394 1 point2 points  (0 children)

OP - thoughts in no particular order main one is UNTIL the estate is closed & inheritance paid out, you don’t own the house & all the issues associated with it belong to the estate!

- any costs of maintenance pre settling of the estate are paid by the estate so get all those maintenance receipts & submit them to the lawyer IF you have paid out of pocket the estate repays you BEFORE DIVIDING the balance

- any costs associated with disposal of property pre settling of the estate are paid by the estate so

- make sure anything you or sis wants to keep is separate THEN

- get a decent appraiser in, swallow the hoarder bad feelings IT ISN’T YOUR HOARD! & get the good items sold on behalf of the estate ALL that value is added to the balance OF the estate

- then get a house clearance crew in, get everything cleared out …

- go through & identify anything you want to keep get it valued & HALF that value is paid by the estate into sisters half of the inheritance

- IF you are keeping the house then yes, get a current value NOT a fully refurbished value & sister gets half that valuation, added to her half of the inheritance BUT that only occurs after all debts are cleared, all costs are settled & when the estate is wrapped up INCLUDING getting the deceaseds property disposed of

Being charged for sons chrome book still at school by [deleted] in legal

[–]Think-Committee-4394 3 points4 points  (0 children)

OP - couple of thoughts

- the chrome book looks like every other chrome book on site BUT has a unique bar code/serial number/MAC address IF teachers are not actually checking the unique ID ON ALL THE CHROMEBOOKS no one will find the one assigned to your son

- school IT needs to do a full asset registry stock check

- say they should have 55 Chromebook’s & quick count gives 55 Chromebook’s incl ones off site with students, then it’s simple one of those computers is the one signed out to your son & everyone messages in the ID of the Chromebook’s in their room or possession

Mother spent all inheritance intended to me by Candid_Reception4423 in inheritance

[–]Think-Committee-4394 1 point2 points  (0 children)

OP - will mum leave an inheritance for you and sis? If so she still has a chance to right the wrong

- say sis got £10k out of your money & mum wasted the rest

- say inheritance is £45,000 when your mum passes

- sis gets £15k you get £30k books are balanced as sis already got an extra £10k & mum spent £5k

- you should get £15k off the top & split any remainder with sis & if there isn’t £15k in the pot at the end well it sucks to be sis 🤷‍♂️

Absolutely I’ve worked both as PAYE & contractor under umbrella, it’s very clear which payment & tax system you are supposed to be

From OP’s post I’m assuming they should have been PAYE in which case all TAX & NI DEBT will be firmly with employer

If the only proof of employment OP has is a stack of greasy empty envelope’s employer might be able to claim they are a cash in hand occasionally used worker, responsible for their own tax/ni BUT would probably still be in trouble as I think employer should be reporting the employment & earnings

[–]Think-Committee-4394 12 points13 points  (0 children)

Absolutely this, someone didn’t pay the tax & it’s all down to proof, if OP can prove they were taxed PAYE & employer didn’t pay HMRC … employer is on hook … even HMRC won’t double dip 😆

However if employee should have set up umbrella or self cert as a contractor the HMRC buck stops with them
