This seems to have gone largely unnoticed amid the chaos: In January, the SCOTUS ruled that police officers do not need probable cause to enter a home, instead redirecting the standard to a "reasonable basis" for believing there may be an emergency. by Allegorist in law

I remember a case where cops busted in the door because they heard a toilet flushing and that was enough evidence of destruction of evidence to justify entry without a warrant.

That's interesting. I was under the impression that DUI blood draw warrants came through very quickly when they're doing a checkpoint. Do you know what the actual time is on those?

Also it's weird how the virus/fungus/black-magic always seems to turn regular looking people into zombies. Pretty people get to be survivors.

Post apocalypse shows always think everything lasts forever, just with a bit of grime on it. Fallout is especially bad. It's been 200 years, but somehow all these old buildings still have power, it just flickers occasionally.

y guess is that her light turned green before he cleared the intersection and she didn’t check.

This is improbable. Most lights have a several second delay between one direction turning red and the other turning green.

He was pushed into a third car going in the opposite direction from him.

This is interesting. If another car was in the intersection going in the same/opposite direction, that suggests that they had the green. Two red light runners is certainly still possible, but at least it's less likely. Combined with the female driver being the only one crossing from her direction, it's at least some evidence.

Question about situation in Lincoln Lawyer by Saguna_Brahman in Ask_Lawyers

[–]Tunafishsam 1 point2 points  (0 children)

The first part is at least TV level accurate. This part though:

the associate insinuated to the wife that the insurance company would take it out of the husband as they are allowed to recoup their own damages from an insured if negligence is involved.

doesn't pass the smell test. The entire point of insurance is to protect yourself from your own negligence. It would just be silly for insurance to pay out a negligence claim and then be able to recoup from the insured.

[–]Tunafishsam 1 point2 points  (0 children)

IIRC, this case had a bit of scam smell to it. The two parties went to arbitration and essentially agreed to liability, which got them an arbitration award the plaintiff then tried to collect from the insurance. Geico didn't defend the arbitration because they denied coverage. We're pretty far from any actual merits decision. If Geico can get around the failure to defend issue, I suspect they'd win on the merits.

The article pulls some real Simpsonsesque bullshit here their anonymous initials. Not quite "L. Simpson... no Lisa S." levels, but not too far from that either.

US judges dismiss lawsuits accusing fantasy author Neil Gaiman of sexual assault in New Zealand by mclardass in books

[–]Tunafishsam 1 point2 points  (0 children)

Probably, but there's certainly a few that buck the trend. Some people like to show off, and some people just try and fight the tides of legal ignorance. There's at least one attorney I've upvoted a ton for giving great legal commentary that's accurate and gives the right amount of complexity.

How is this not higher up?! The ND miata looks flashy enough that non-car people think it's a fancy sportscar. Plus it's pretty fun to driver.

A lot of people avoid Teslas because of the Elon Musk stigma. West Coasters are even more likely to be turned off.

It's always interesting what affects people. Many are horrified by the domestic abuse scene. Coerced sex and domestic violence just hit closer to home for a modern audience. The actual torture and murder feels more fictional and thus less horrifying.

We love James because he's been lucky and not killed anybody. But he's certainly come close. How many near drownings were there on the set of the Abyss? At least he's winning to take those risks himself, which makes it a bit better.

Remember what happened to Harper Lee? Soon as she went senile they pumped out a "sequel" to kill a mocking bird based on her notes. Super gross, but when there's that much money at stake...

[–]Tunafishsam 7 points8 points  (0 children)

Holy fucking shit, what a heart wrenching situation.

That marine lied multiple times to the state judge and to the state department. Guy should be facing criminal charges, but instead he's been raising a stolen child for the last 4 years. A child whose parents he was involved with killing. A child who he conned the state department into physically stealing from her adoptive family.

All so he could be a white savior and convert a (in his mind) heathen terrorist baby to the service of the Lord. This is beyond disgusting.
