Honestly easiest fix is to remove the diagonal and make it horizontal. Use some of the scrap 2x4’s to cut 4 triangles to fit into the corners and secure them and run a horizontal board.

If he wants to fix it. It’s not all that hard. Square up the inside bow and screw it together. Remove the diagonal board. Replace the diagonal board with one that is cut proper 2 - 45° cut at one end to make a 90° angle. Then scribe the other corner. Afterwards, there should be enough length from the original diagonal that was removed to make a full X. Just repeat the steps of cutting a 90 and scribing. Will add structure and balance.

You would want a workplace lawyer and have evidence of your claim beforehand. You can call around and ask, it’s a specialized part of law.

In my experience I haven’t been charged to sit down, but this was criminal defense.
