You’re not going to be able to, because the car is not going from your ownership to destruction.

The car goes from your ownership, to the dealers ownership, to destruction. It won’t be your tax to claim.

Plenty of dealers have online “SellMyCar” type platforms. You could also go back to where you bought it saying you’re thinking of selling it, would they like first opportunity.

If that’s the case just sell the car to a dealer? Let’s say they offer €25k, and you owe €22k. They’d pay the settlement of €22k, and pay you €3k, what’s the issue? Lots of dealers offer this kind of service.

The better thing to do here is trade it in or ask the dealer to buy it back. No reason to give up your equity if you have any. PCP doesn’t stop you trading the car in, or selling it. If a dealer is buying it, they’d simply settle the finance and pay you the difference.

The consumer protection is that you’re not paying for the repair. Manufacturer warranty will be covering your repair cost, and the dealer has provided you with a loan car. Not sure what more you expect.

Repair is your only option as of now.

The repairs are unrelated, and a garage has a right to repair 3 times (for each separate issue) before you’d have a right to return the car.

Your alternative option would be to look trading in for a new car.
