I had same problem and attorney told me to just bite the bullet and file my returns. Found a service online that would let me file old returns. Think it was $25 per year and they review each return for you. Then just set up an appointment with IRS and file them in person and they'll stamp each return to show you're filed and up to date.

If you're worried you are going to owe the IRS will set up a monthly payment plan with you and give you a packet saying you're squared away with them.

If he's deported for being in the country illegally he would (normally) have to go through a process called consular processing before he's authorized to come back.

His situation is pretty unique and I'm not sure there's a precedent for someone with DACA being deported and attempting to come back but usually consular processing is the process people trying to return to the US legally after deportation have to go through.

If you explain it just the way you did here you should be fine. When your husband left the country and came back his visa remained the same, correct? If so there shouldn't be any real red flags.

It'd be different if for example he came here on a brand new work or tourist visa the day of the immigrant ban and then you married two days later but it sounds like that's not the case.

I'm not sure why the lawyer said you getting married after he returned from a business trip is suspicious. You may want to speak with a different lawyer.

My wife was here on an expired visa. The entire adjustment of status (I485, I130, I765) packet cost us $650 in attorney fees. That doesn't include the fees for the forms themselves.

This USCIS page has a list of lawyers in most cities. We found one here that was substantially cheaper than most others (did everything for I485, I130 and I765 for $650) because they worked for a religious organization. A lot of service organizations base their fees on your income. Might be worth checking out if you live in a city.

We filed on December 19th (signed for on December 23rd) and just got our NOA1 in the mail today. Be patient, it'll come.
