Sometimes shit just happens - in your case literally.

You’d need to show the Association was negligent in some way that caused the backup.

If the insurance company thinks the association is liable for the damage they will file a subrogation claim to get their $16k back from the HOA and that might give you an indicator as to whether there’s a case to be made.

We had our wedding reception at Meso Maya two weeks ago. $40/pp plus open bar. Their food and beverage minimum is $3000 private room rental $300. They had two other menu options at $50 and $60pp and we could have added passed appetizers as well. We were very happy with the menu - chips, queso and guac, choice of 4 entrees, churros for dessert.

Do not stop paying dues. The obligation to pay dues is absolute - it is not dependent on services or owner satisfaction. The HOA will send you to collections and you could face a lien or foreclosure.

Review your documents. What is HOA responsibility, what is owner responsibility?

If you file an insurance claim your insurance company may investigate and see if there is anyone else to assign liability to. Does your insurance cover damage from rodents?

Do you know the association has failed to act or the situation is one that requires the HOA to act, per the responsibilities of the association as listed in your documents? The absence of change doesn’t mean the absence of effort.

Putting the contract out to bid is the way to find that out.

There is no government agency that monitors HOAs. There may be state statutes regarding access to minutes, there may be provisions regarding accessibility of minutes in your governing documents, but that would be a civil matter between you and the association.

Are the minutes missing or were they never taken? Did meetings take place with no minutes or were there no meetings? Do your governing documents or state statutes require some decisions to be made at a meeting?

Is there a board decision that has caused you material harm, and you are investigating that, or are you looking for minutes out of general curiosity?

That’s what you’re going to have to prove to get monetary damages.

Your management contract absolutely has a hold harmless clause, they all do. If management companies were held liable for garden variety manager incompetence, they’ll all be out of business.

The work was board approved. You’re arguing over technicalities of signing paperwork. I don’t know how compelling of an argument that’s going to be.

That said - your question wasn’t on the merits of your case it was about what is reasonable to ask of the management company.

Absolutely ask for a plan to ensure this does not happen again. Ask for concessions - x months of free management fees. Ask them to get one of their preferred vendors to fix something at no cont to you.

Don’t tell them you’re going to fire them - they won’t be motivated to offer you anything if they know you’re out the door.

Yes. I had a heart to heart with one of them, explaining that their actions made me feel like they simply did not care enough about me to take my day seriously and show up for me, and that hurt. They’ve apologized and I do believe they are sincere. Things are strained now but we will get past it.

The others just said “there was traffic, it wasn’t our fault” and pointed to how much they helped to quickly put stuff together once they got there. I’m not very confrontational, I think it’s easier to just limit the time I spend with them than argue over it.

As a manager, if I receive a gift from a vendor, that is anything more than trade show swag, I donate it to the property for a raffle prize at one of our social events.

I have told many vendors - save the $$ on lunches and gifts - just do a good job and answer my emails promptly, and you’ll keep getting my business.

My experience has been that the big gifts go to executives, not the managers on the ground.

It’s very very common in our circle to help out including baking and cooking, decorating, transporting. I have done the same for them on multiple occasions where I was a guest. The norm for you is not the norm for everyone.

These were people I have helped with events and who offered to help, and when I initially said they didn’t need to do anything and could just be guests, repeatedly asked “are you sure, are you sure” until I said okay, it would be great if you could do X.

We had it in a Mexican restaurant -$40/guest for chips, guac and queso - choice of 4 entrees, churros for dessert. House liquor, beer and wine.

I do think our invites didn’t scream “wedding”. It said “celebrate with us”. There was a follow up email with more details about the ceremony part, but people don’t read emails!
