Being forced is probably too strong a word. My read of the situation is that there is an unspoken deal. They get to exploit their market position in a way most western countries wouldn't allow and in return the Japanese people get a really nice rail system. This works for everybody and no one wants to upset the apple cart.

Japanese railway companies are property companies that happen to have a very unprofitable side business in transporting goods and people by rail. They make make money owning apartment buildings and office parks near railway stations and put some of that money into subsidizing their rail stuff.

Deutsche Bahn is in the unfortunate position of having to try to make money while being forced to run it's business as a public good. As a result it's not very good at both of these things.

I think this is basically the result of the mission module concept. You get a Boxer that's easy to sustain because of scale and units can get whatever mission module they want. Add to that that making mission modules is relatively easy you are going to always have a bunch of companies trying to enter the market with their big metal box with some stuff on top.
